A Federal High Court sitting in Kano, yesterday, dismissed a suit challenging the tenure of Mr. Babatunde Fowler as Executive Chairman of the Federal Inland Revenue Service.

The court, presided over by Justice Lewis Allagoa, struck out the suit when it upheld the preliminary objection filed by Fowler’s counsellor and Senior Advocate of Nigeria, Paul Erokoro, stating that Stanley Okwara, the plaintiff, had no locus standi to file the suit.


Justice Allagoa came to the conclusion after an hour-long review of all the legal authorities cited by Erekoro, T.A Ghazalli, counsel to the Attorney-General of the Federation, who is the second defendant; and JohnMary C. Jideobi, the plaintiff’s counsel.

He said he could not see how the rights of the plaintiff were affected by the non-appointment of the Executive Chairman, FIRS after August 15.

He agreed with Fowler’s counsel that the plaintiff had no cause of action and that it was fatal to his suit that he didn’t file a pre-action notice to the court, as required by the Federal Inland Revenue Establishment Act (FIRSEA) 2007.


“I agree with the first defendant that the plaintiff ought to have served the defendant with a pre-action notice. Learned SAN asked the court to strike out the suit. I so hold,” Allagoa said.

The judge also upheld Erokoro’s submission that the suit should be struck out as there was no “justiciable cause of action”.

Ike Odume, FIRS Director of Legal Services, saluted the court, saying: “My Lord, we thank you for being forthright in this matter. Thank you for doing justice. It cannot be less. I have been following this court from Enugu. I know you will always do justice. Thank you.


“My Lord, we will be asking for costs. We have come all the way from Abuja three times because of this matter. We will be asking for costs,” said Odume.

Justice Allagoa, however, overruled Odume.

“Don’t kill a fly with a sledgehammer. Parties should bear their costs,” he held.

The counsel to Okwara, Jideobi, was represented in court by Barrister A. Issa.


About a fortnight ago, Fowler’s counsel, Erokoro, ed by Odume and counsel to the Attorney-General of the Federation, Ghazalli, in a preliminary objection, asked the court to strike out Okwara’s suit

Erokoro and Ghazalli told the court that Okwara had no locus standi to file the suit in the first place and that the suit should be struck out as the court had no jurisdiction to entertain it. Both maintained that the proper place for the suit is the National Industrial Court.


But Okwara told the court that as a legal practitioner, he had a fundamental human right to file the suit and he had a duty under the Legal Privileges Act to uphold the Rule of Law.

The plaintiff had asked the court, in the suit (No. FHC/KN/CS/141/2019) to order Fowler to vacate his office, which, he claimed, had expired on August 18, 2019.

Okwara claimed that Fowler was appointed on the 20 August 2015 and that his tenure had expired as FIRS Chairman after 20 August 2019.


Citing the provisions of Sections 3(2) (a), Section 4(a) and Section 11 (a)” of the FIRS Establishment Act 2007 and the decision of the Supreme Court in Ogbuinyinya & Ors. vs. Obi Okudo & Ors. (1979) All N.L.R. 105, Okwara claimed Fowler has no business to continue to hold office.

He also asked the court for an order directing Fowler to refund to the Treasury Single of the Federation all the salaries, emoluments and other monetary benefits he has been drawing on the purse of the FIRS and file an affidavit of compliance within 14 days after the delivery of judgment in the suit.


But in a notice of preliminary objection dated 30 September and filed the same day, Erokoro noted that the Okwara has not disclosed a special interest.

Given Okwara’s failure to establish his locus standi to commence the suit and for failing to abide by Section 55 of the FIRS Establishment Act by filing a pre-action notice on the FIRS Chairman, for failing to present any reasonable caucause of action, Erokoro asked the court to strike out the suit.


Citing Senator Abraham Adesanya Vs the President of Nigeria, (1986) 5 SC 112, Erokoro said the Okwara need to have actual and real interest in the suit before he can sue.

The Coalition of South East Youth Leaders (COSEYL) has called on the Federal Government to make Innoson Motors a national brand.

Innoson Motors is the first indigenous (Nigerian) automobile and bus manufacturing company founded by Innocent Chukwuma and runs a plant in Nnewi in the state of Anambra.

A Lagos-based businesswoman, Ejioma Ahibafu, 49, on Monday told an Ojo Magistrates’ Court how she paid back “in kind” part of a N1.1 million loan she allegedly took from a man.

The defendant, a trader who sells bags of rice, pleaded not guilty to a two-count charge of obtaining money by false pretence and stealing brought against her.

The defendant, who spoke in pidgin, told the court that the said loan was obtained after a friend introduced her to the complainant.

She said that although she was given the loan, she also delivered some bags of rice to the complainant with an understanding to pay up the balance.

Besides, the defendant informed the court that even before she was given the loan by the complainant, she had to pay him in “kind” on three different occasions in a hotel.

The Prosecutor, Mr Simon Uche, had earlier told the court that the defendant obtained a loan of N1.1 million for rice business from one Emma, a businessman, with a promise to pay back the money in six months.

Iran has arrested an Angelina Jolie ‘lookalike’ on suspicion of blasphemy and instigating violence after complaints about her Instagram posts.

Social media star Sahar Tabar, from Tehran, shot to prominence on Instagram after posting images of her eerily gaunt face, with some people saying her appearance resembled that of a ‘zombie.’

The 22-year-old reportedly had 50 surgeries to make her look like the Oscar-winning actress, but she later confirmed most of her distinctive look was achieved through make-up and editing.

Tabar has been arrested on charges charges including blasphemy, inciting violence, gaining income through inappropriate means and encouraging youths to corruption, Tasnim news agency reported.

She was detained on the orders of Tehran’s guidance court, which deals with ‘cultural crimes and social and moral corruption’, late on Saturday.

Most of the photos and videos shared with her 26,800 followers have also been heavily edited so that she seemingly resembles Hollywood star Angelina Jolie.

The features images of her pouting lips, sharply turned-up nose and razor-like cheekbones.

In July Sahar unveiled her former appearance for the first time, sharing a side-by-side snaps of her pre and post surgery.

The World Igbo Youth Congress narrated on Saturday it took a careful analysis of the Igbos misfortunes in the 2015 and 2019 general elections and has observed that Peter Obi contributed in no small part to the recorded failures.

This was made known in a press statement made available to the media by its President General, Mazi Alex Okemiri.

Peter Obi was the Campaign Manager Southern Nigeria for the former president, Goodluck Ebele Jonathan in 2015 and also the running mate of the People’s Democratic Party Presidential Candidate, Atiku Abubakar in 2019.

“World Igbo Youth Congress took stock of Igbos misfortunes in 2015 and 2019 general elections, and [has] observed that Igbos had better options.”

The group said it did observe such action should not be allowed to repeat itself again.

“We know those who were behind the hasty decision of Ohanaeze Ndigbo in 2015, when the then General Muhammadu Buhari wrote to have an audience with Ohanaeze Ndigbo regarding 2015 presidential election

“Which was unsuccessful based on the efforts of former President Jonathan Campaign Manager for the Southern Nigeria [Peter Obi], and which also repeated again in 2019 when Ohanaeze Ndigbo hurriedly miscalculated without due process to endorse Atiku ahead of President Muhammadu Buhari

“…[These were piloted] by the same man who made Igbos to lose in 2019.

A paedophile dad fatally shot his daughter in the face after she went on a date because “he wanted her for himself”, a court has heard.

Ronald McMullen, 45, has been convicted of murdering ex-cheerleader Kailee McMullen, 22, at his home in Oklahoma, US.

A jury has recommended that he should receive a life sentence.

He had pleaded not guilty to the crime, and claimed that she accidentally shot herself.

But, when cops were called to the scene in June 2017, Norman police Lt. Chris Vinson said he was immediately suspicious that McMullen was involved, as he was covered in blood and let his wife, Karen, answer questions for him.

At his murder trial at Cleveland County District Court, his lawyer, Michael Johnson, said Kailee shot herself and that gunshot residue on her hand ed that theory.

But prosecutor Jacobi Whatley disputed that claim.

A Norman police officer testified that McMullen moved his daughter’s body and phoned his wife before calling 911.

The court was told that there were “some dynamics in their relationship that were disturbing,” according to the Norman Transcript.

Prosecutor Jennifer Austin explained: “This was years and years of a relationship that was very difficult and very controlling.

“You can tell in the text messages that it was almost like a controlling boyfriend-girlfriend relationship.”

A political group in Nigeria alleged there are fresh plots aimed at tarnishing the Vice President, Yemi Osinbajo reputation by some political actors from within the Presidency referred to as the cabal.

The Initiative to Save Democracy (ISD) says there is a calculated attempt by the cabal in collusion with some South West leaders to peddle outright falsehood, fake news and lies against the Vice President.

In a press statement issued on Saturday and signed by the National Secretary of the Group, Peter Oladele, the group claimed it has reliable information that the cabal will stop at nothing to distract the Vice President from doing his work.

The statement paraphrased noted the cabal are allegedly working tirelessly to malign the Vice President’s reputation and integrity after they could not find any wrongdoing evidence against him.

“The first thing they attempted to do was to destroy the relationship between the President and Vice President but that has not worked despite deploying different strategies from inside and outside.

“Then they tried to malign the Vice President’s reputation by throwing up all sorts of trump charges against him but with no evidence of wrongdoing that soon crumbled.

“They even referred to the N5.8 billion NEMA Emergency Intervention, the N90 billion FIRS Campaign Fund and other fake news but all those failed too because they were fake news from the beginning. They even went after those who have backed the Vice President,” the statement said.

ISD then explained that the cabal is cooking more fake news and lies against the VP and this time its in conjunction with South West leaders.

“In the coming days and week, there will be fake news and lies about the Vice President in the media and social media space yet again, most of it fabricated by the cabal and some people who claim to be South West leaders led by a former governor of Lagos who is afraid of VP’S rising profile.

“Their plan is to oust him in time before 2023 elections which is still very far away.

The Ekiti State Governor, Dr Kayode Fayemi, has on Saturday stated that his istration would commence payment of the N30,000 minimum wage to Ekiti workers this month (October).

He noted that the payment of the minimum wage was to motivate workers, especially teachers, to deliver the best to the state and reclaim the lost glory and pride of being the education nerve centre of the country.

The Governor, who spoke amidst cheers by highly elated teachers and public servants in attendance at the 2019 World Teachers’ Day celebration in Ado- Ekiti on Saturday, however, tasked teachers to strive for the realisation of the bid to return the state to a leading position in education.

He said, “We will commence payment of N30,000 minimum wage to workers in Ekiti with effect from this month. We are determined to reward diligence because the workers, particularly our teachers, have done the state proud.”

Dr Fayemi, who reiterated the determination of his istration to protect and preserve the core values of making Ekiti the nation’s education capital, said he decided to establish more schools in Ado Ekiti to decongest schools in the capital city and make learning environment more conducive.

The Governor said, “The only way we can reclaim our lost glory in education is to encourage our teachers in and outside service. I will promote functional and technical education in this state.”

Fayemi said that the ongoing recruitment of over 2000 teachers into the public primary and secondary schools was part of the mission of the istration to safeguard the future of the state. The newly recruited 2000 teachers, according to him, are to fill consequential vacancies arising from retirement of teachers adding that the teaching profession still needs brilliant, agile and vibrant men and women for the sustenance of the profession in the state.

The Governor said: “I have also ensured that all students of school age are in schools in line with Education Law which makes basic education compulsory and in line with global best practice.

“In this year’s West African Examination Council Senior School Certificate Examination, Ekiti was ranked 12th. I want to salute our teachers, but that is not where Ekiti belongs, we must continually do more to rise to number one”, he said.

The governor, who further stated that car and housing loans would soon be extended to the primary school teachers, added that names of two Tutor-Generals would soon be announced. This he said, will put teachers on the same pedestal with their civil servant counterparts with potential to rise to the position of permanent secretary.

Fayemi said his istration would continue to pursue the mandate of the National Policy on Education which makes it compulsory for all school age children in Ekiti State.

He said, “I note of course what the chairman of NUT said here about loans being extended to primary schools teachers, and I want to assure you that that will be given very serious consideration.

“I also want to let you know that government has concluded plans to ensure that we commence the payment of minimum wage of N30,000 with effect from this month.

“Let me state specifically that two new Tutor-Generals appointments have been approved and would be announced in the next week and the third one of course would follow with the retirement of the third Tutor-General.

“On the other request relating to promotion, arrears of salaries and leave bonuses, I want to assure you that we would not renege on our promise and we are doing all we can to set outstanding obligations to all. As I have assured you at my recent meeting with all workers.

“I wish to state emphatically that we are running with the time and vision to ensure delivery of the dividends of democracy to all the good people of Ekiti State.

“In other words, we will do everything humanly possible not to leave any stone unturned in making life easier and more comfortable for our people both at home and in diaspora.

“The present istration in Ekiti State under my watch is poised, committed and highly determined to restoring, preserving and guiding our core values for posterity.

“May I reiterate at this auspicious moment that, Ekiti State Government will not renege on its promises to pursue free, compulsory, functional, basic, affordable, enterprising, quality, technical and vocational as well as entrepreneurship education.

This is to ensure that all the school age children in Ekiti State are in school in accordance with the mandate of the National Policy on Education, Universal Basic Education Law and Sustainable Development Goals with Quality Assurance practices and global best practice.”

According to Governor Fayemi, “some of the remarkable landmark achievements and initiatives of this State government in the education sector include but not limited to the following: Enactment of Executive Order 001 prohibiting the collection of levies and fees from the pupils and students of all the public primary and secondary schools across the state; disbursement of running grants for the first, second and third of 2018/2019 academic session to all the public primary and secondary schools in the state; ongoing renovation of the dilapidated structures in some schools and distribution of free JAMB forms to 3000 candidates across the 16 Local Government Areas of Ekiti State.”

Other achievements according to him are: establishment of four new public secondary schools in Ado-Ekiti metropolis to decongest some of the over populated secondary schools in the State Capital; payment of Bursary for students in Law School for 2018/2019 academic session; training and retraining of teachers in all the subject areas to build their skills and capacity for efficient and effective teaching and learning activities in the schools; regular payment of teachers’ salaries, allowances and personal emoluments including granting of loans and payment of core subjects and rural allowances to the teachers of core subjects and teachers serving in the rural areas respectively.

While congratulating the teachers and the critical stakeholders in the Sector, Fayemi implore all the well-meaning Ekiti people to hands with him to move education forward to the next level of glory, urging teachers not to rest on their past glory but strive harder to be the best in their chosen profession.

In their remarks, the NUT Chairman and his ASSUS counterpart in the state Comrades Samuel Odugbesan and Sola Adigun respectively commended the state government for being labour friendly.

The labour leaders praised Fayemi for recruiting teachers into public schools across the state, saying this will help in strengthening the future of education.

They however appealed to government to pay all arrears of salaries, leave bonuses as well as effect promotion of deserving and qualified teachers.

A gilded coffin looted by art thieves in the wake of the Arab Spring and unwittingly purchased by the Metropolitan Museum of Art in New York has been returned to the Egyptian authorities.

The sarcophagus dates back to the first century BC and once held the mummy of Nedjemankh, a priest of the ram god Heryshaf.

BBC reported that the highly ornamented coffin was bought by the museum for $4m (N1.4 bn) in 2017 and was the centrepiece of the Nedjemankh and His Gilded Coffin exhibition that opened the following year.

But in February the coffin was seized by a New York unit investigating the trafficking of antiquities.

“Thus far our investigation has determined that this coffin is just one of hundreds of antiquities stolen by the same multinational trafficking ring,” Cyrus Vance, Manhattan’s district attorney, is quoted by the Reuters news agency as saying at the ceremony to return the coffin.

After it was taken from Egypt’s Minya region amid the political upheaval of the revolution in 2011, it ed through Dubai and and on to .
