As its influence within the federal government grows daily, one question routinely emerges about the Department of Government Efficiency: Who is in charge?

That answer continues to evade the lawyers tasked with defending President Donald Trump's istration in court.

In an affidavit filed in federal court on Tuesday, a White House official clarified that Elon Musk is not the of the newly formed entity -- seemingly contradicting public statements by Trump.

"I am pleased to announce that the Great Elon Musk, working in conjunction with American Patriot Vivek Ramaswamy, will lead the Department of Government Efficiency," Trump said in December 2024. Since then, and following Ramaswamy's departure from DOGE, he has routinely referred to Musk its leader.

However, according to Office of istration Director Joshua Fischer, Musk is neither the nor an employee of DOGE. Instead, Musk is a "non career special government employee" who serves as a senior adviser to the president. The filing compared Musk's role to that of Anita Dunn, a longtime political adviser who served as a senior adviser to President Joe Biden.


"In his role as senior advisor to the President, Mr. Musk has no greater authority than other senior White House advisors. Like other senior White House advisors, Mr. Musk has no actual or formal authority to make government decisions," the affidavit said.

The filing comes after Judge Tanya Chutkan – who held a hearing Tuesday in a case that challenges the breadth of Musk's authority – raised concerns about the "unpredictable and scattershot" methods employed by DOGE.

"DOGE appears to be moving in no sort of predictable and orderly fashion," Chutkan said. "This is essentially a private citizen directing an organization that's not a federal agency to have access to the entire workings of the federal government, fire, hire, slash, contract, terminate programs, all without apparently any congressional oversight."

Federal judges are also wrestling with how to define DOGE itself. In an order issued Feb. 14, a federal judge in Washington, D.C., ruled that DOGE should be considered an "agency" -- though he noted how the Trump istration is "curiously" avoiding that label.

"This appears to come from a desire to escape the obligations that accompany agencyhood — such as being subject to the Freedom of Information Act, the Privacy Act and the istrative Procedures Act -- while reaping only its benefits," U.S. District Judge John Bates wrote.

White House claims Elon Musk does not run DOGE in new filing.The filing did not provide any information about who oversees DOGE, other than ruling out Musk.

The mystery about DOGE's organization and leadership does not appear limited to of the public; lawyers for the Trump istration have similarly struggled with the question in court.

After a court hearing on Friday about DOGE's access to sensitive Treasury Department payment systems and records, Christopher Healy, senior adviser to the Treasury Department's general counsel, had little to say when asked about who runs DOGE.

"I don't know the answer to that," he told reporters Friday afternoon outside federal court in New York.

“We fight against Trump and we fight for a country where everyone belongs and where everyone is included and everyone has a voice,” she added

Speaking to a crowd of protesters carrying American flags and home-made signs that includedd the phrases “where law ends tyranny begins” and “save our democracy,” Greenberg and dozens of other speakers took turns on the microphone calling out the Trump istration’s effort to freeze funding and halt the operations of numerous federal agencies, including those that oversee medical research, environmental protections, public education, air safety, and social safety net programs like Medicaid.

Carlos Álvarez-Aranyos, a public relations consultant and founder of the newly formed anti-fascist group American Opposition, said the country is living under fascist rule four weeks after Trump was sworn in as president.

“It became fascism the moment he fired the civil servants who had investigated him. It continued when he began shutting down federal agencies without congressional approval. And it has reached a fever pitch as he has empowered Elon Musk, a private citizen with no expertise in this area whatsoever, to steal our data and destroy our government like he destroyed Twitter,” Álvarez-Aranyos said during the Capitol Hill protest.

Without Congress or the U.S. Supreme Court, with a 6-3 conservative majority, pushing back on Trump’s policies, he said the U.S. system of checks and balances has failed and called on the American people to defend democracy.

“I have a message for Donald Trump and every other fascist: You’re pitting yourselves against the collective power of the American people,” Álvarez-Aranyos said. “Make no mistake about it. You don’t stand a chance

If you consider the real reason why America doesn’t have the level of infrastructure and amenities that other 1st world countries have (racism), it will make sense to you why people vote against themselves. It’s okay as long as the group of people they hate so much will get punished in the process. Historically White people vote against all kinds of social amenities because there’s a chance it will benefit black people. Same sentiments can be found in all groups today even black folks when it comes to general wellbeing.

Like I have said, it's all a sham. Follow the money. If they were intent on cutting waste, they would have started at the Pentagon.

They don't have the balls to go after the Military Industrial Complex where toilet seats are being sold at $10k a piece, but want to convince us the wastage at USAID is what the US needs to get back on it's feet.

There is a reported $125bn (estimated) wastage, but they are not starting there first. They want to continue keeping 800 military bases over the world but remove entire agencies that families.
