Content creators and posting rubbish. It is practically impossible for any financial institution to grant a loan request, mortgaged by a landed property, that doesn't belong to the borrower. How did the bank officer ascertained that the building belongs to the wife? Even if the building is in the name of both couples, the bank will still request the express approval of the t owner, to accept that the asset would be used as a collateral for the loan.

My colleague in the office fell victim to this same scenario too, his wife sold his house for 50 million in Abuja. The mistake my colleague made was he bought the property in the name of the wife.

They can't take the house. I think it's just mere content. Firstly, she presented documents that doesn't carry her name. Why didn't the people insist on the husband's approval of the loan? If she says the man is death, then you ask for his death certificate. It's that simple. Let them go and deal with the woman how they want. They can't claim the house. It's a simple matter.

Actually, the man has not said the truth.
Few years ago, there was this reigning local scam by guymen that were no longer making money from international 419. Most had big houses but no money. They will release documents of their houses to relatives or cohorts to sell or take huge loans. Some may be slightly altered documents or some were so brazing to give out "oluwole originals" . When they are sold or heavy loans are taken, they share the money. Meanwhile the fellow comes out to claim he never knew of the sale or loan adding different stories of how eg his documents were stolen or faked. The buyer or creditor looses their money. Afterall if you buy stolen property, it is your loss and not tat of the owner.

If your land documents gets stolen, you'd be expected to report immediately. If you were issued a C of upon purchase of your property, your C of O would come with a unequie serial number and an issuance date. which once reported would be deactivated provided you can provide receipts of purchase and other evidence to prove that the property belongs to you.

So whoever is buying the property, if he's wise he has to go to the state ministry of lands to confirm the originality of the document in his possession before making payment. Or else his money would enter one chance and can be arrested for theft.

The woman in question took the documents without her husband's knowledge to get the loan. So since he wasn't aware that his property documents were missing he couldn't file any report.

now you are making EVEN less sense!!! so because the wife took the documents, it automatically makes the documents legit for her to get a loan from the bank (even if it is clearly stated on these documents that its not hers to sell)?

You can be legally liable for a lot of things things done by your wife. If it was his adult kid, he can make a case, but as long as it's your wife, your own done be. smiley

If only his name or both their names are on the house documents, then the creditors have no case. You can't take a loan with a property that isn't yours or isn't fully yours.

Even with documents,the banks will still pay several visits to the property to ascertain there is one,to value it and then the documents.So all the while they visited,they didnt meet the man in the house?

It matters and it would turn to a court case. If the house is solely in the husband's name, the wife cannot use it as collateral without his explicit permission. And if the house is owned tly, both parties would typically need to agree to use the house as collateral. The wife cannot unilaterally take a loan secured by tly owned property without her husband's consent.

He cannot be compelled to pay her debts. He didn't co-sign the loan agreement with her.
