How could the bank accept Mr. X's documents as collateral when the borrower was Mr. Y?

This story doesn't add up.
If her name is not on the document then I don't see how this is possible.

The man should head straight to court.

The only downside is that his wife I'll end up in jail

It's not a downside, every scammer deserves a jail term irrespective of whose ox is gored.

In Nigeria if you rent a car, the original documents of the car wouldn't be given to you. The company you rented it from would provide a driver, your job is to sit like a boss and enjoy your ride. Besides banks in Nigeria don't accept cars as collateral for loans cos anything can happen to a car. It could get stolen or could have an accident.

ok fair enough.. so if armed robbers come to your home and steal your documents (or better yet, you friends come stay with you and steal it), they can thereafter go to the bank and use your home/land ownership papers to ask for a bank loan WITHOUT THE CONSENT OF THE LAND/HOME OWNER?!

Looks confusing. How's this possible?

Believe this and you'll believe anything. No financial agency that is legitimate will accept a collateral not in your name. They are also mandated by law to do due diligence.

This case is null and void. The court will throw out the case in a minute.

makes no goddamn sense whatsoever... so again, if tomorrow i rent a car, i can bring the original documents of that car to the bank and get a loan (without the consent of the owner of that said car)?

so anyone who has any original title (that dont belong to them) can just waltz into any bank and use these documents to ask for a loan (without the consent of the owner)?!?!?

The man might have put both his name and his wife’s name on the document. Shebi that is what you youths have been preaching.

Any woman that tries that nonsense with me, her whole family will pay for it, if not, na Ogun and Sango go settle the matter. This case no concern Jesus at all

Where is the court order?
Where is the wife?
Did she set him up? Is her name on the property ?

Get a lawyer if her name isn’t on it it she has no right to use the property as collateral

He should go and look for money to pay the creditors and save his house. She is his wife, na him go marry foolish wife, so he must carry his cross. If it were to be his son that did that will he throw him into prison. Failure of his wife, it is equally his failure, because he didn't train her well enough

It's a good downside for her to end up in jail.
She is a dubious and evil woman.

The loan company too I don't understand if that's normal to accept collateral belonging to someone else.

As long as she has access to the original documents of the house, whoever owns it doesn't really matter. Cos the bank or whoever granted her access to the loan are only interested in the originality of the collateral and not who owns it. Bad kids do this all the time. They steal their parents house documents and sell off the property

The mistake the man made was revealing to her where the original documents of his house was.
I don't think that this story is real. The bank can't just give yoy a loan simply because you have access to the documents. They will ask for it to be in your name or for the owner to co sign on the loan. Something is fishy here with this story.

Who name is the house in? Then we can know what to say.

Also how much loan did she take? And what did she do with the loan?

He needs to get his lawyers to advise him.

If your land documents gets stolen, you'd be expected to report immediately. If you were issued a C of upon purchase of your property, your C of O would come with a unequie serial number and an issuance date. which once reported would be deactivated provided you can provide receipts of purchase and other evidence to prove that the property belongs to you.

So whoever is buying the property, if he's wise he has to go to the state ministry of lands to confirm the originality of the document in his possession before making payment. Or else his money would enter one chance and can be arrested for theft.

The woman in question took the documents without her husband's knowledge to get the loan. So since he wasn't aware that his property documents were missing he couldn't file any report.

Fake story!

I don't believe anyone will accept an asset such as a land as collateral for a personal loan if the title documents are not in the name of the borrower
