INEC conducting elections does not mean the LGAs are being controlled by the Federal Government. Is it not the same INEC that conduct State Governors and House of Assembly elections? Has the FG been controlling the States and Houses of Assembly as a result?

The good thing about INEC conducting elections for LGAs is that the elections are going to become mandatory and more credible and not just subject to the whims and caprices of the State Governors. It is a good development.

The best route and not the back door the supreme court went through.
Let all necessary amendments be done to give it more ground than causing hiccup in the system.
I heard that the Adamawa state governor has gone to the supreme court for the interpretation of section 162 because there is no where in that section that empowers the FG to send local government allocation directly to them. The subsection 6 says the FG shall send the accrue to state and local government to a state t local government .
They should have allowed the national assembly to tinker that section before making such pronouncement because Nigeria is a constitutional country and not a banana Republic.
As good as that judgement was, it goes against the spirit and letter of the constitution.

Now, let me make my bias known on this issue. The bill will NOT scale through because it has to go go through the state assemblies and the 2/3 of them must sign it or agree to it. As we all know the state assemblies are the appendages of the state governors. The governors will really prevail on their assemblies not to concur the bill.

State LG Govt t does not mean State and LG money together in one . The federal government will be the one paying into the state LG t and not the State government.
The only way to adjust the constitution is to amend it or change it.

The federal government do not pay any money to anyone.

The States and FG both agreed the calculation, sign and share money from the federation .

Laws are not change by court ruling based on sentiment.

No doubt the ruling was good and the intent was good but I am surprise that people that suppose to talk kept mum and those that talked gaslighted and behave as if nothing happened.
I was surprised that the supreme court have Turned themselves to lawmakers and no more interpreter of laws. Ruling that the allocation of the local government council should be sent to them directly is totally anti constitution because know where in the constitution that prescribed that. The allocation to the local government and state are to be disbursed to the state t local government section 162 subsection 6 very explicit.
I know Nigeria is a constitutional country and ruling should be based on the existing laws and not back door ruling as done in this ruling of local government istration finance.

English language is very nuanced. State might just refer to a collective of where the LGA areas are situated, not necessarily the State government. I’m still trying my best to describe it.

If you notice in 3, there is a distinction btw the term, State Governments and the term, State.
