The most important thing in the law is the spirit of the law and not the letters of the law. That's why the Supreme court explicitly stated that the state governors has abused the privilege accorded to them.
The supreme court ruling has effectively established an autonomous third tiers of government and this is very important for the development of the country and Nigerian democracy.
The fear of political meddling in local government affair by the Federal government is secondary and should not becloud our resolve to give more opportunities for development to local level.
Imagine some towns and local government being at the mercy of their Governor. Some Governors will seize the allocation of local government and use it to develop another place. The Supreme court ruling is valid
Today ruling you won't know the implications till days or months to come. 1. Are you aware that is the same state governor that will conduct election into the local government posts, because SIEC still under their control.
2. Secondly, the supreme court have constituted themselves as lawmakers and not law interpreter and this started during Jonathan's regime when the same supreme court said Jonathan has the right to sack Lamido Sanusi Lamido and the same repeated during Buhari's regime on naira design and mopping of old ones.
They have severally go outside the constitution to establish new laws not in the constitution.
3. The ruling will make the governors to be more vicious and do everything within their powers to make their stooges to be chairmen, as they have been doing before now.
4. According to constitution, we only have 774 LGAs. What becomes the LCDAs created by many states? Because till date the constitution have not recognized them and no allocation for them till date. Would FG give them monthly allocation as from this month?
5. Coming months we would see, hear and perceive the effects of this ruling today.
6. For me, it is a full scale coup against the constitution and nothing more. They should have allowed the national assembly to tinker with the constitution than going through the back doors, since we are constitutional government and not judiciary government.

Even if the LGA are varies but the least will not get less than 2b for last year in Edo state. We have two major problems impending development in Nigeria. Governors are the first and lawmakers. Thank God the governors era of muscling the LGA will soon be over. To get rid of the lawmakers, is for us to vote candidate with good record in any party we find them and not because of party. We witnessed it with labour party last year, where the noise of top to bottom, made many to vote in most of the candidate with questionable characters like many in Apc and Pdp.

What Tinubu is trying to do is to invade the domains of the state govs by using the LGs. He knows like everyone else that the LGs were put under the states by the Constitution. You might not like it but that is how it is. The states are the gateways to the LGs. Expect ALGON, NULGE etc etc to soon release statements thanking Tinubu for this "landmark" move. Expect visits to Aso rock from them soon as well. It is a case of abuja boys vs the govs. If it was not, the NASS would have been the best place to achieve this without the assault on clear provisions of the constitution

How did Yahaya Bello became a governor? Flawed judicial system that ratified a rogue that wasn't even in the ballot.

Fix your electoral system so that the process is credible and people with credibility can win elections and use the state resources judiciously!

I don't understand what the complaint is about.

The judgement is good news. No more "Baba sope" LG Chairmen in future hopefully.

I believe that the residents will monitor their funds better this way. Even if they in the looting, (EFCC on the lookout for more "customers" grin), at least half of the funds will be spent within that space. It will make a huge impact on the economy in the long term.

All the caretaker chop I chop committees will come to an end. Better qualified people will contest for elections at that level which is good for development.

What Buhari wanted would have made amending the constitution straightforward without the state govs stopping it with their selfishness. Once state legislatures are financially independent, they can take decisions without sucking up to govs. It was same SC that quashed it. Same SC is now giving fake autonomy that does not exist to LGs. It is intellectually fickle people like you that don't see the big picture. Very interesting thread.

There is a minority on here that is making a valid point about how the judiciary is nudging us all towards a constitutional crisis. This minority has pointed out how clear the constitution is - on the matter of a t to be operated by the states. I'm no constitutional lawyer but it certainly does look like judicial overreach if the supreme court overides the very clear wording of the constitution on this issue. Most posters on this thread agree that section 162(3) has not worked out in the interests of ordinary Nigerians and thus...it should go. What is less clear to these posters is that Nigerian lawmakers should have been the ones to amend the provisions of the constitution...in order to serve the interests of ordinary Nigerians. That is what Nigerian legislators are being paid to do...legislate!

There is a very serious problem if Nigerian lawmakers cannot enact ostensibly popular legislation on behalf of the people they represent...and instead we all have to wait decades for a supreme court verdict that overides the very clear wording of the constitution it is supposed to interprete. undecided What this means is...the system is broken, full stop. It isn't working.

Ok...back to the practical realities of the supreme court's verdict. I will say without any fear of contradiction that the celebrations on this thread are premature - because we all know the country in which we live. A country without institutions just doesn't work properly. Without the institutional reform that is urgently needed, we will all be back here in a short while to complain about the excesses of local government chairman and state lawmakers...or some other weird failure in the system.

It won't be long before it happens.

There is something there in his last comment. I am sure there are millions of business and political arrangements or agreements all over the world that are similar in form to our state/LG t arrangement...and they work. And why do they work? They work because those other places in the world do have strong institutions...and there will be consequences if one party violates the agreement/arrangement and starts tampering, touching or fiddling with things. The system doesn't just sit back when one party (usually the stronger one) abuses its powers - the system kicks in and the law is enforced. That is the power of having strong institutions.

We don't have that here.
