There is every indication that the newly inaugurated governor of Osun State, Senator Ademola Adeleke, is on his way out of government as the Tribunal hearing the petition filed by Alhaji Adegboyega Oyetola of APC has accepted as evidence the forged documents he submitted to the Independent National Electoral Commission as attached to Form CF001 and EC9. The documents have been a subject of arguments in the last one month at the Governorship Election Petition Tribunal sitting in Osogbo.

Whereas his counsels had fought gallantly to discourage the Tribunal from demanding for the documents, they ( Adeleke's counsels) had no other choice today than reluctantly submitting the documents as requested.

Documents tendered as exhibits include:

(1) The forged West African Examination Council GCE result which he purpotedly sat for in December 1981.

(2) An obviously forged Testimonial purportedly issued by Ede Muslim Grammar School, Osun State of Nigeria in July 1988 at a time Osun State was not in existence. Osun State was only created by law on 27th August, 1991, out of the old Oyo State.

(3) A Letter of Attestation from Ede Muslim High School issued on 22nd May, 2016 but signed by the same principal that signed his purported Testimonial which he collected in 1988! Recall his Testimonial carries Ede Muslim Grammar School.

(4) A forged NECO result purportedly issued in 1981. NECO came into being in 1999!

Before today, the Tribunal had received as exhibits a Bachelor of Science degree in Criminal Justice from Atlanta Metropolitan State College, USA, which Adeleke claimed he obtained within a period of 24 days. It is important to note that BSc degree in Criminal Justice in Atlanta Metropolitan State College is a four-year programme as indicated in the College's Worksheet and Program Map for the course. How Adeleke obtained within that short time, a degree whose duration is supposed to be four years, is still a mystery.

Counsel for Oyetola, Lateef Fagbemi (SAN), was beaming with joy when he received the documents, having understood that the primary evidence to prove the forgery allegations against Adeleke has been handed to the court.

Contrary was the experience for counsels on the side of Adeleke because when the Tribunal chairman asked the INEC to open their defence, sensing outright defeat, he begged profusely for an adjournment which was granted by the court.

When the court reconvenes on December 20, it is for Adeleke's team to defend their client's 'Oluwole' results.

OSUN GOVERNORSHIP TRIBUNAL: A PEEP INTO OYETOLA'S FORGERY ALLEGATION.

This is another fairly long but expository piece, I must state at the beginning. In the election petition filed by the immediate past Osun State Governor and his APC, the petitioners alleged over-voting, non-compliance and non-qualification. The focus of this piece is not on their allegations of over-voting or non-compliance but on non-qualification as they seem to have technically abandoned their claim of non-compliance and over-voting, obviously in view of the reality of the cross-examination by the Respondents' counsel which has rendered such claim to become evaporated.

In Ground 1 of their petition, they alleged that Adeleke was not qualified to contest the July 16th, 2022 Osun governorship election. The facts and particulars supplied by the petitioners in of the ground of non-qualification insinuate that (i) Adeleke did not possess the requisite educational qualification to contest the election (ii) that he presented forged certificate to INEC at the material time of the election. (iii) that the Penn Foster High School Diploma Certificate and the Bachelor of Science in Criminal Justice from Atlanta Metropolitan State College presented by Adeleke were forged. (iv) that Adeleke submitted forged certificate in his Form CF001 to INEC in 2018.
(v) that Adeleke forged the academic documents presented by him which suggested that he got his degree within a period of 24 days, and that he didn't possess any document to have qualified him for the Diploma and the Degree.
(vi) that he attached a Testimonial bearing Ede Muslim Grammar School, Osun State, with a 1988 date, to his 2018 INEC form, (meanwhile Osun State was not in existence as at 1988), while in his INEC Form for the 2022 election, he attached a Letter of Attestation from Ede Muslim High School dated 22nd May, 2016, stating that he attended Ede Muslim Grammar School, from 1976 to 1981.
(vii) that the letter of attestation cannot be equated to a testimonial and that it is at variance with the information supplied by Adeleke as to his secondary school attendance.

I am not rendering this piece to argue whether the issue of qualification especially as regards information supplied by a candidate on the INEC Forms raises a pre or post election issue. I am dealing with the merit of the forgery allegation by the Petitioners. The petitioners have a load heavier than mount Arafat on their shoulder to be able to establish forgery. Dealing with the merit of their claim, I will quickly dismiss the allegation of forgery of the High School Diploma and the Atlanta College Bachelor of Science Degree Certificates as baseless. The Schools are there to attend to any inquiry about the genuineness of the respective certificates issued to Adeleke. For the purpose of clarity, the High School Diploma was not the pre-requisite for the Atlanta College Degree as both certificates are independent of each other. That is that about that. Now, to the issue of 2018 INEC Form CF001 and the 2022 Form EC9. The bottom line is that a person doesn't need any certificate at all to be able to attain educational requirement for qualification to contest governorship election in Nigeria. Anything, even if it is an attendance which shows that he attended a secondary school or it's equivalent is enough to qualify him academically. The only thing that can make the forgery allegation fly is if Adeleke did not attend the School he claimed in his Forms. The truth of the matter is that Adeleke attended Ede Muslim Grammar School between 1976 and 1981 in the old Oyo State. He applied for his testimonial in 2018, as at the time, the School has been renamed Ede Muslim High School, and it is no longer in Oyo State but now Osun State. It will be impracticable and unreasonable to use anything relating to Oyo State while the School is now in Osun State, and its name has changed as at the date Adeleke applied for his testimonial. He was taken up on this in several litigations both civil and criminal. He was vindicated. He was held and confirmed not to have forged, though he was cautioned of negligence for not going back to that school to correct the errors and mistakes in the Testimonial, the Court vindicated him that WAEC brought his statement of result and the spread sheet which confirmed that he sat for WAEC in 1981 at Ede Muslim Grammar School. The School Principal also itted that the errors in the testimonial were from him and not from Adeleke, and that the errors in the testimonial notwithstanding, Adeleke attended Ede Muslim Grammar School which has been renamed Ede Muslim High School. If he now has a letter of attestation evidencing his studentship in the school as against the error-laden testimonial he got before, what is the fuss!

Without more, the fact of the exam body and the school principal giving evidence that Adeleke did not issue any of the alleged documents by himself but by the appropriate authorities, that has settled the whole issue. Whether Ede Muslim Grammar School, whether Ede Muslim High School, irrespective of any error or mistake (if any) in the Testimonial or the Letter of attestation, the irresistible conclusion is that Adeleke is educated up to school certificate level and he is eminently qualified to stand for the election. The Court of Appeal decision in RAHEEM.V. PDP (2019) LPELR in which Senator Ademola Adeleke was vindicated is instructive. In that case, the Court of Appeal Abuja refered to a previous decision of the Court of Appeal, Akure between Senator Ademola Adeleke .v. Kingsley Awosiyan & ors to come to the conclusion that the issue of Adeleke's educational qualification has been settled in a judgement in rem which is binding against the whole world. Therefore, under no guise can anyone re-open the issue of his academic qualification and forgery again. I understand that the Petitioners are working to achieve a result with the decision of the Apex Court in Saleh. V. Abbah which held that the INEC Form is a certificate and any false information on same amounts to forgery and forged certificate, I dare say that the decision of the same Apex Court in Agi. V. PDP vindicates Adeleke which is to the effect that notwithstanding any inconsistency or incongruence in the information supplied by a candidate in his INEC forms, he can not be disqualified on of that in so far he is found to have been ordinarily qualified to contest the election. To make myself clearer, without the Letter of attestation and the Testimonial which the Petitioners have made an issue, the WAEC result and spread sheet evidencing Adeleke's enrolment for WAEC in 1981 is solid evidence of his attaining education up to School Certificate Level. In fact, a school receipt evidencing payment of school fees at secondary level without more is enough to qualify one for election in Nigeria as far as educational parameter for qualification is concerned.

The conclusion here is that, for whatever it is, Adeleke's academic qualification is unquestionable, so there is nothing to fear. The mandate freely given to the son of Late Senator Raji Ayoola Adeleke by the Osun electorates has come to stay. I therefore say "KOSIGIRI", that is " No shaking".

I could have glossed over this journalistic reportage by Ismail Omipidan,who happened to be a media aide to Alhaji Isiaka Adegboyega Oyetola in his first term in office as the governor of the State of Osun. But for the simple fact that the subject matter he is referring to is a legal matter,l just consider it expediently necessary to clear the minds of the reading public about the innuendos contained in his write-up.
Let me say this from the beginning of my response that legal matters,especially election procedural matter is "sui generis".
It is a class on its own with distinctive features on how to go about it.
If Ismail Omipidan think he can use sensational report of this nature to raise the hope that his paymaster,the erstwhile governor of the state of osun,Isaka Adegboyega Oyetola have justiceable course at the Election Tribunal,he is just deceiving himself.
If the other variant is to hold APC hip in osun state intact in preparation for the 2023 General elections so that their candidates in all the elections can still be pitied by the electorates,Ismail Omipidan is wallowing in ignorance and illusion.
Whatever his views are on his update at the on-going Election Tribunal in Osun State is wasteful exercise.
As a legal mind,l will like to correct his erroneous beliefs in a simple logical sense so as to decontaminate the unsuspected minds of the reading public who may be confused by reading through his falsehood.

According to Ismail Omipidan,the 2 issues APC/Isiaka Adegboyega Oyetola raised before Election Tribunal for determination are:

(1) That Senator Ademola Adeleke was not qualified to contest election at the time he did.

(2) That there was over-voting in 749 Polling Units across 10 local governments in the state.

On the first claim,the appropriate questions to ask Ismail Omipidan are:
Which agency of government has the right to screen and determine who is qualified to contest an election? Is it INEC,Tribunal or court? What is the constitutional requirement for contesting for the post of governorship of a state?

In answering the first question, INEC is the only agency of government that has the right to screen and determine who is qualified to be a candidate in governorship election.
With this simple fact,either Election Tribunal or other courts of the land cannot usurp the functions of INEC in this regard.
Succinctly put by the 1999 constitution of the Federal Republic of Nigeria as amended in Section 177
,
"A person shall be qualified for election to the office of Governor of a state if-

(a) he is a citizen of Nigeria by birth,

(b) he has attained the age of thirty-five years,

(c) he is a member of political party and is sponsored by that political party,and

(d) He has been educated up to atleast School Certificate level or its equivalent.

The relevant section of the Nigerian constitution quoted above,particularly sub section (d) clears Senator Ademola Adeleke as qualified to contest for the post of governor.
It is upon this prism that INEC based its screening in 2018 which the Supreme Court of Nigeria later affirmed that Adeleke is qualified when thesame APC/Isiaka Adegboyega Oyetola made an issue out of it then.
Is Ismail Omipidan and his ilks in APC celebrating certificate issue again in 2022 not aware of the Supreme Court judgement on thesame? Of what importance and relevance is their counsel asking INEC to bring Senator Ademola Adeleke's certificate through subpoena as used in 2018? Is that effort not in futility? I pity them for presenting ignorantia ad-homien fallacy in the public glare.
Though,it is their legal right to subpoena on any issue to buttress their claim,but it is equally important they consider the veracity of such action.
An action that will paint them in bad light in the public as desperately ambitious ought to have been discontenanced with.
In this instance case,it is only the Tribunal/Courts that will tell them the issue of disqualification in the mode they are saying it is pre-election matter which has been foreclosed with Senator Ademola Adeleke's clearance by INEC either in 2018 or now in 2022.

The second leg of their claim in the Tribunal is the issue of over-voting in 749 Polling Units that cut across 10 local governments of osun state.
This is ridiculously laughable. Can they prove this within the 15 days alloted them to prove their case?
Of all their witnesses brought so far before the Tribunal,how many of them can they boast of fortifying their case?
Instead,they are turned to hostile witnesses with their evidence turning against them during the cross-examination of PDP legal luminaries.
The ACN l know in 2014 at the Election Tribunal,that later transformed to APC in 2018 will be beating their chest by now that they will win the case if their case is super.
Their reliance on the certificate issue and over-voting 2022 is meaningless and senseless legal pursuit.
If there are to be incident of over-voting,APC is the only political party in Osun that can be accused of this,as the party in power in the state with government machineries to make this to happen.
Accusing PDP of over-voting is like chasing a mere shadow all about.
Head or tail,APC is loosing this case. There is no substance in their matter at the Tribunal.
All the evidence tendered at the Bar through their lawyers which people were scared of as something reasonable are mere junks dumped on the Tribunal.
So also the pieces of evidence tendered by APC State Returning Officer are all waste products that will be kept as dumping refuse in the storehouse of the Tribunal if there is no credible witness to activate them in line with legal precision.
Each of the evidence can be made use of,if the Polling Agents used on the election day that were present at the Polling Units to witness what transpired in the 749 Polling Units are brought to court as witnesses and are cross-examined by PDP,INEC and Ademola Adeleke's lawyers. Anything short of that is regarded as hearsay evidence that the Tribunal cannot rely on.

I take my time to say all this in order to allay the fear of some people who think all that are being said by Ismail Omipidan are real.
He is just wasting his time in his journalistic rascality.
When we are talking of law,Senator Ademola Adeleke is the governor of Osun State whose APC falsified claim at the Election Tribunal cannot remove.
Ismail Omipidan and his APC cohorts should note finally that election matter is not won on the pages of social media.
The sole determinant is Election Tribunal and later Court of Appeal and the Supreme Court as the case may be.
Ismail Omipidan should also note that PDP is now the government of the day in Osun State. That the table of power that turned against them has made APC the opposition party in the state.

Having regards to the fact that the nomination of governorship candidate and deputy governorship candidate is a t ticket section 182 (1) of the Constitution provides that no person shall be qualified for election to the office of Governor of a State if he or she fails to meet the conditions stiputed in the section including the presentation of a forged certificate to the INEC. The same prerequisites are applicable to a deputy governorship candidate pursuant to section 187 (2) of the Constitution''

Uhm... About the testimonial, it is signed when you come for it nah. People who graduated in 2000 can come for their testimonial in 2022 and it will be dated 2022 when they were issued.

They should have asked one of their Comrades that work with schools before going public with that.
