I don't know the law here, and as I put it up earlier on this thread, in some jurisdictions, there are specific laws that protect minors from being prosecuted if two of them have sex willingly and are under the age of consent. (that applies to the US, and in some states, not all).

At the end of the day, however, I'm going to err on the side of caution (and yes, I mean err)..and assume that a ten year old cannot give consent, even if her partner is also ten. Lawyers in the house should be able to give a better view.

But the main koko here is the fact that the school failed in its duty of in loco parentis big time.

It is a Catch-22 situation. The school cannot sack the teacher without taking responsibility. But self-acquittal would cost them so much more. They were not properly advised. This is a school with immense resources. I think Chrisland management needs to lead by example by acknowledging their error, fire some top notch management and all the of staff found culpable, set up a sort of t Committee of stakeholders; school and affected parents to help counsel, rehabilitate and discipline the children. This should not have escalated to this point. What a mess.

If they had handled this well, the parents recognizing their own failure as parents and in order to protect their child, would have been relieved. In the end, we want the children involved to turn out well and other children also protected.

If at all she didn't want to partake, she did everything wrong from the start, leaving her room to retrieve a charger, taking a drink (could be spiked with drugs), and for keeping such a thing quiet. Many parents would be angry and take that out on her. It may not be the right response but very common reaction esp in African homes.

That said, I saw it trending on Twitter and I refrained from commenting because Ubi could be quite an alarmist and they are all kids, which makes it trickier. Chrisland failed in that they should have summoned all the parents to a meeting and let them know the events that played out in Dubai or wherever. That is how it used to be when I was growing up. All these elite schools and the extent they go to protect their reputation.

Yes, Chrisland should have done more. The situation was badly handled. They should have insisted on meeting with the parents much earlier and the two sides take responsibility, come to a mutual agreement to the best interest of the children involved and draw up a way on how this can be prevented in the future. And maybe notify the appropriate states agency.
