Where I live stamp duty is not relevant on rental property contracts only on mortgages or lease...contracts are contracts...just like. Nollywood legend osuofia said...."agreement is agreement " signed and sealed...issible in any court...

Thanks for your response but I disagree with your submission.

Stamp Duty for a tenancy agreement is not a requirement in most western countries and I have rented spaces in a few of them.

In the U.S, some states do have a default tenancy agreement form on the state/county/city website that a landlord could just print off and use. Stamp Duty not required even in the event the landlord's lawyer drafts the tenancy agreement. Notary is not even required for the document to be legally binding.

The reference you made about buying a house.. in the U.S some documents requires notary which the desk jockey at the closing company can do.

Also, don't confuse power of attorney with tenancy agreement. Them two have different legal guidelines .

The word "agreement " means two people have agreed on an issue .

An agreement is legally binding if the two parties agreed on it by,

1). By word of mouth.
2). A text exchange
3). Email exchange
4). And offcourse our very popular ink to paper.

Most judges don't like the word of mouth because it places a heavy burden on the court to determine who is telling the truth and who is stretching the truth. Offcourse since the case made it to court, there has been a disagreement and they come to court to seek redress.

For those building on a budget, Linoleum flooring is acceptable for the complete house save the bathroom if the bathroom is a wet room and far cheaper but the problem in Nigeria is that floors (German floor) are not polished off. To lay a Vinyl or linoleum flooring, one needs to first polished off the floor. This is a near-perfect flooring solution (alternative) to tiles if one is building on a budget. For a moderate three bedroom, the cost savings can be well over 300k depending.

Tiles and Tiles..just wondering do people actually consider using linoleum flooring instead of the ceramic tiles...so called plastic Tiles.....below pictures are my kitchen floor and small hallway...they look like real tiles or naija weather would not suit it..lol

This happens already...on a studievisit to beer factory carlberg..they already have automated robots that wakes up and packs and sorts beers....prepares customer's order for delivery ..full automated system...there are still functions human perform..so many other companies have robotic system ....so many ehandle warehouses also.

Really it seems I have always been quoted high prices for this service. The first time I made drawings was in 2012 and it was 500k. I made another one in 2014/15 for 700k. I did not build any of those as I changed my mind, sold one of the land and still keeping the other. This one of 1.4 million was done last year and I am about completing the building now. My friends get quoted similar figures for their drawings too so I am baffled at the prices guys are quoting.

Seems you are giving them richman vibes...offcourse you will/would be billed for that....

Well, covid 19 not only changed how businesses are carried out, it changed consumer behavior as well....

Lots of people are weary of crowded place these days which is the bread and butter of malls, (foot traffic..)

But as sad as it might sound, Amazon have an upper hand in the whole thing because they were in it already, buulding on their infrastructures opening up facilities left and right...

Lots of businesses will survive no doubt... in Nigeria, online business will be a bust because we don't have the infrastructure set up right in logistics... matter of fact, our heads are not wired like that.

You know how Amazon started? They perched on USPS to provide the logistics while they took their time and slowly built theres..

In Nigeria, that's a tough sell.. have you been at your local post office lately?? Those nipost workers shenanigans ehn... I tire oo


Known fact online business in Nigeria would take time....skepticism and poor logistics....buliding trust

Malls are becoming Obsolete in the U.S precisely.

Amazon was and still is the number one killer..

Malls are just on the brink of death by a thousand cuts. Do you know how many malls are sitting empty in the U.S? Lots of them,

Most business renting the large spaces are "reinventing " themselves and investing more in the online space.. less overhead and more efficient (sort of).

Some big tenants are gradually going out of business, SEARS etc.. Jenney, Macy's, Kohls etc.. refusing to renew their leases in some locations and rather diverting to online sales. Moreover, foot traffic have reduced as well in the malls.

Funny enough most of all the big mall tenants are in one financial trouble or another... late last year, there was a rumored take over of Jenney by Amazon ( I pray that's not true ).

I get that Amazon and online businesses are the new ball game....infact covid19 brought about redefinition of how businesses are carried out. But businesses are evolving and ing trends...some are quick and some will not survive....but it would take a while

Malls Obsolete ?? Not so far away from me is a major mall construction by venture capitalist... there are currently over 50 mall construction/plans in different stages either planning or contracts stages or construction...my county and many others count Malls as development ...its been difficult for malls with covid-19 the past one year.little ease of restrictions..people are trooping in... I live just outskirts of Gothenburg..

You can combine....Well....my kitchen is mostly wallpaper only have tiles behind cooker and dish/wash areas.... which are located in same wall...dining and refrigerator and storage areas are all wallpaper...same room...cheers

Haha...you are right.I omitted IBETO for a reason..as of today my brother ibeto still does not manufacture cement in Nigeria as I was told ...he failed to convert nigercem or yet to do so....held import license when they were all importing....his deal to build his plant in Ebonyi fell through.didnt work out...I cannot say for sure if he built elsewhere....he raised good money to build plants ...cannot find it listed anywhere ....have a good day....cheers

Government banned it to save the country from becoming a dumping ground. We have more than 8 cement manufacturing companies, and I don't think there is a law stopping any new Comer, including you.

Before the ban, some of the companies above could not cope, but got a lift as soon as the ban came to light.

We are a people that like the easiest and the fastest route out. We hardly have time to build but we always want to enjoy what those who built are enjoying.

BTW, Trump banned alot of stuffs from coming into the US from China and co, you can look this up.

Let me add my own Ten kobo to the discuss:

You dont really need a Lawyer, if you are willing to calm down and follow the law.
I am saying this because whatever anyone does or says, those that follow the Law will always triumph.

There is nothing wrong in buying a House with Tenants, there are procedures to follow, l have done the same thing not too long ago.

- Once you pay for the House, the transaction is finalised, you wont be getting any money back!
The House is now yours and the Seller owns the money you paid, unless she is willing to BUY BACK the House, from you, as the "Seller", at her own price.

- The problem here is a Tenant (or Tenants) still in tenancy but perhaps unwilling to vacate at the expiration of their tenancy, as demanded by YOU, the New Owner.
True, they have No Agreement with you but the agreement they had with the former Owner, which puts them in "lawful occupation", is now your Agreement (as the new owner).
- The Law requires that a tenant be given a 'minimum number' of Months, as QUIT NOTICE. You obviously have not served such Notice in the PROPER manner. It cant be Verbal, it has to be written and properly dated ('technicality' like that can invalidate it).

- You are even lucky that they have shown their position immediately and not wait till the moment when their rent expires.
The Tenancy Law allows you to serve a Tenant a Quit Notice, within the period of Tenancy but the condition is that such Notice must not expire before the expiration of their Tenancy, it can only end on the date or after the date of Tenancy.

- For a Yearly-paying tenant, they will need SIX Months Quit Notice. For bi-annual Tenants, you will serve THREE Months Quit Notice, for lesser duration of payment, you will serve One Month Notice.

My Advice: Serve them a Quit Notice IMMEDIATELY, if they have less than Six Months left or on the day after their Tenancy remains Six Months (If they pay yearly).
There is nothing you can do about the Six Months Notice, it is the Law.
If you follow the Law, you are protected, dont allow some tenant to rubbish you openly. undecided

- Alternatively, you can invite them to a Meeting and Offer to Refund the "balance of their Rent" in CASH.
If they ALL agree (No point doing it for one, when another will remain behind, ti will still hold you down), Draw-up and "Private Agreement" with them, stating what was agreed and the last day they must be in the House, Include an 'Ouster Clause' that states that "They have willingly agreed to these and wish to the bound by it, ousting any other rule or law that may govern such Agreement between the Tenant and Landlord".

The reason for this "Ouster Clause" is to take care of any of them that may collect a Refund and still refuses to leave on the said date, while trying to go to Court. Ordinarily, the Tenancy Law still governs such relationship and the Law DOES NOT allow you to "forcefully eject them" on the agreed date but with the "Ouster Clause", they have submitted to a "private agreement" between the two of you and ousted the tenancy Law from coming into Play, so you can pack their things out without falling foul of "Self Help", since they would have become "Impersonators" in your building, after the agreed date.

- to go an pay "Stamp Duty" on this agreement (about #1,000) and get it stamped at the Court near you. That makes it enforceable in a Law Court, if you need to or defend yourself with it.

- If they refuse to agree to being paid-off, then you have no choice than to serve them the Quit Notice, but ensuring it expires on the date after their Rent expires. Be sure it ends on the "day-after" otherwise the Notice becomes invalid.
If they fail to leave on that day, you have to serve them another "Seven (7) Days Notice" of "Owners Intention to Reclaim Property".

- If they still refuse to move-out at the expiration of that 7days Notice, you go to the nearest District or Magistrate Court (based on the amount involved) and collect a Recovery of Premises Form N. It is a Judge that will give an "Order of Ejection" of the Occupier.

Any Rent owed between the expiration of Tenancy and this Order would also be ordered to be paid by the tenant (Mesne Profit) and the Court Bailiff will effect the Order and throw out the Tenant, including seizing his Properties for Auction, if he does not pay the ordered arrears on the spot.

So, it takes roughly less than 6-Weeks, after the Tenancy has elapsed, to LAWFULLY eject a Tenant who refuses to leave.
It is better to exercise this patience of time, than to fall foul of the Law, which can land a House-owner in Six Months Prison term and Fines. grin grin

Dont buy the story that it takes years to eject an Occupier, that was decades ago, for only those who dont know how to go about it or commit errors that jeopardises their case in court.
