The government can and has the right to maintain status quo if it decides to challenge the lower court rulings up to the apex courts.
This is why Kanu was still held in DSS custody until the final supreme court ruling..

Appeal court freed Kanu on let us say 17th January 2025

Did FG appeal the case in supreme court on 17th January 2025?

If not, what is stopping Kanu from being released on 17th January 2025 till when the FG would have successfuly filed the appeal?

Let us assume the FG successfully filed the appeal on 18th January 2025, Kanu should have enjoyed 24hrs freedom before being detained if status quo must remain.

What are you talking about? The case of rendition is a civil matter. The Appeal Court ordered Nnamdi Kanu's release, the government went and asked the same court to suspend its decision while it appeals it decision at the Supreme court.

What it means is that if a magistrate court determines that an accused person has no case to answer, and orders his release, the accused might spend years in detention as the government appeals from the high court, to court of appeal to Supreme court. How can someone spend years in detention, with court judgement for release, while another goes on appeal?

The point is that Nnamdi Kanu was kept in detention for over a year before the superior court said no. In other words, Kanu had a judgement for his release, the judgement was suspended to allow the Nigerian government appeal for one year.

If Kanu is convicted today and sent to jail, do you think he will have the right to ask the court to suspend the judgement so he can go for apoeal for a year? No way! They will send him to jail to begin his sentence, and he can appeal from jail.

But when Kanu wins in court, they will suspend the judgement, keep him in detention and go for appeal?

That's judicial rascality
