The votes, is it for the Party or the candidate?, if it's for the Party he cannot leave, except his tenure ends but if it is for the candidate, then he should be able to leave. This part need to be interpreted by the court to clear the ambiguity. Defection has been there in the past between the Parties, is it now they are noticing it?

When political office holders where decamping from their parties to the PDP during the era of PDP in power at the national level they were most welcome by PDP and now they are reaping the reward of accepting elected officials into their party. They should stop crying or complaining or both and allow APC to enjoy their turn because when they are out of power they will also suffer the same thing..

The court needs to make a bold statement about defectors.
If truly the vote is for the party and not candidates, it's really immoral for someone who finds the party uninteresting to continue to enjoy the mandate given the party.

the only bold statement the courts can make to serve as deterrent to wayward defectors is to declare their seat vacant and install the second winner of the highest votes cast. I just pray the courts will one day sack a sitting governor for decamping

APC after winning zamfara, had its votes cancelled
by the supreme court. Rather than use violence they used peaceful overtures to convince matawelle to them. As much as there are many things to criticize APC for, this singular act puts them aside from the demonic wickedness of PDP.

If indeed you believe the mandate belongs to the APC, he should have resigned before contesting under the PDP.

Did you not hear that obaseki was disqualified from APC before moving on to PDP, contesting there and winning with the party.
Those errors in the past must stop. If you win with PDP, finish your tenure with the party and if you win with APC equally finish your tenure with the party.

Going by your comment, Obaseki should have first, resigned from APC on whose platform he became the Governor because his tenure wasn't over yet so he did all you mentioned on the platform of the APC.

Anyways, this is not new and it's gonna continue until the part and court do something about it.

There's no such law, the courts can rely on.

Except if the NASS such law. And even at that, it will still be subjected to subjective interpretation as its not in the constitution.

The only way out is to expressly state it in the constitution that once you change party, you resign whatever position you occupy through the party.

But this will make the parties too powerful, and they may start bullying elected leaders.

zamfara is a supreme court gift to PDP. Zamfara is a core APC state. APC cleared all positions from national assembly lawmakers, state assembly lawmakers, Governor, locsl govt chairmen and councilor. Pdp didnt win a single seat in 2019.
Supreme court gave pdp on a platter.

That Bayelsa court too was whose court.

Which Mandate?
I have stopped comments on both APC and PDP,for they have nothing for ordinary Nigerians
who themselves as confused as ever!
The Mandate that made you ruled for 16 years
and nothing to show for it!
The APC that should have sealed up the so called
Mandate but failed in Security, Nepotism and
Unemployments of great proportion.
It then means that Nigerians are yet to get it.
Stop depending on the Parties that are making
you poorer.The Youth should know that they can't be
hobnorbing with the devil and still wants to eat their Cake
and have it in their hands!
2023 is very crucial decisions for the Progressive Youth,whose ideology should be different
