Sorry for the refusal. Again, this refusal holds no weight. In fact, the ECO did not give any cogent reason as to why your application was denied. A third refusal means that they have low confidence in your profile. They are dancing round the circle to ensure you are not approved. Maybe they are skeptical because you have not demonstrated familial ties through marriage, children, or even elderly parents. But then, that cannot be everyone’s reality. Maybe you lack travel history to desired countries, but at least you’ve traveled outside Nigeria a few times and back (with Qatar being a very strong economy). If you apply again, it will just lead to another refusal with a different reason. You need to take action somehow. As such, you have a strong case to file a complaint or PAP. Your gainful employment, ownership of assets and to an extent your travel history are grounds for a good argument. I suggest you send in a complaint demonstrating how this refusal decision is unjust and flawed. Or, you can hit back by sending a PAP (a more complex route and which might take a longer time to resolve). Either ways, this is not a decision to just fold your arms and accept hook, line and sinker. First of all, sorry about the refusal. It is frustrating to say the least. In my opinion, these refusal reasons do not hold so much weight and you potentially have a good case to send the Home Office a complaint challenging both reasons. For reason 1, people change addresses every time and they forget to update their bank s to reflect that sometimes. As it is, the ECO did not question or declare your bank statement as fraudulent/fake. They actually acknowledged its authenticity. Now, the burden of proof rests on you to confirm that you are the owner of the . If you have anything to show when you opened the or even to prove that the address on the statement is your dad’s address, then I suggest you get these documents together, and send in a complaint challenging the first refusal reason. For reason 2, if indeed your opening balance is what they question, and not a huge deposit that appears in the first month of your bank statement, I suggest you counter this reason by proving that you have always been in possession of the stated amount. People can build their bank s overtime, so I suggest that you furnish your claim with historical bank statements of up to a year to prove that the money is indeed yours and it has naturally accrued. As long as the statements are clean and devoid of any large unexplained sums, attach as evidence in the same complaint email. This is only a suggestion and you can choose to make an attempt on it, or make a fresh application, but including sufficient evidence addressing all the reasons for the previous rejection. Just my two cents! P.s. another thing to think about is whether your application was refused due to your immigration history. Sure! A complaint is different from an appeal. If you feel the ECO has made an error in your decision and you want to call their attention to it, send an email to [email protected]. Since you’re looking to do it yourself, make sure you present your issue in a sensible and professional manner. Identify all the areas you feel they overlooked with reasonable measures and make them see why it was a flawed decision. The Home Office can be tricky as they might come back with a different reason for refusal. That is why your case must be foolproof before you try to pushback. I suggest you analyse your case thoroughly and ensure you understand the merits before proceeding with a complaint. You are not guaranteed a response, but if you feel you have a shot and want to shake them further, get a lawyer to send a PAP. borryworld: |

Visa Refusal Overturned! If you feel that the Home Office adjudicated your visa application wrongly, sometimes it is important to go the hard way and hitting back can potentially bring about a positive outcome. My lawyer advised me to do just that when my mother’s application was refused a second time with another flimsy excuse. The first refusal was due to unexplained funds in her . We waited for a while and put in a second application for her to visit for Christmas. Everything seemed perfect. More than 20 documents submitted with sufficient funds in her , employment and property ownership documents. I submitted everything necessary and opted to be her sponsor. Her application for entry clearance was refused. The Home Office refused her application on two grounds: (a) unexplained increase in salary from her previous application, which we explained with evidence - very laughable!!!! (b) that they were unsure if her sponsor would still have a valid leave by the time of her visit (a stupid move, because my ILR had been approved the previous month and the ECO probably didn’t check the BRP submitted). The lawyer laughed when he saw this and told me to lock horns with the Home Office. We sent a Pre-Action Protocol (PAP) Letter on 30th December 2024 asking the Home Office to reconsider its decision or we proceed to judicial review. They replied on 8th January asking for 3 months to review the case. We sent a reminder mail on 9th April, and the Home Office decided to overturn its decision yesterday. They apologised and asked for the port to be submitted to VFS. Imagine if we took the high road and accepted such nasty fate, when in fact we had a strong case! If you feel an injustice against you has been done by the Home Office, take it legal sometimes. This does not apply to most visa refusal cases of course, but if you feel a reconsideration is warranted then go for it by sending a message to the complaint office or getting a lawyer to send a PAP. Yes, it cost me more than £1200 in legal fees, but I got the right outcome! If we had accepted it and reapplied, they would’ve found another excuse to refuse her again and her record would’ve remained tarnished. 9 Likes |

Gurus in the house, please help me out here. See my mother’s rejection letter below. The two reasons they gave are addressable issues. I offered to fully sponsor her with 2200 GBP and even attached my 6-month bank statement showing over 30000 GBP with invitation and sponsorship letter, and all the sponsorship docs needed. Only to be rejected (5 days after biometrics) on the grounds of unclear funds in her bank statements, which we explained as transfers from her children, other cash gifts and repaid loans in a cover letter and in the extra information box (a series of payments not exceeding 150000 NGN, some even as low as 3000 NGN, and no lump sums apart from transfers from me and my siblings usually around 125000 NGN). Also, as a government worker, there are little payments here and there from the FGN. Payslips were even added! We submitted her bank statements just to fulfil all righteousness to show that she’s able to take care of herself back home - and that has spelled doom! I equally noticed that the second paragraph/reason was about how much her expenses are (and they quoted figures in Ghanaian Cedis, which shows me that they’re just writing anything as reasons for refusal these days). I indicated that her monthly costs amount to 70000 NGN, bearing in mind things like gas, food, fuel, DSTV and even the fact that she takes care of her late sister’s daughter. Maybe this was an understatement on my part. Fine, she renewed her professional license a month or so ago, maybe the huge amount threw the ECO off guard - but still! How is one supposed to have a fixed expenditure every month? Not even the ECOs have that. Also, for someone who has a sponsor and has submitted sponsor’s financial and tenancy documents, and self-introduction letter from sponsor, why are they talking about if her funds will be “genuinely available to [her] in the UK”. In the application form, I indicated that she’ll only spend 10 GBP of her money, whilst 2200 GBP has been earmarked for her 10-day trip this Easter (with a budget submitted even). This is ridiculous! The reasons for rejection are starting to seem mundane and rehashed - it all appears to be basically rushed. We submitted a comprehensive application with at least 17 documents (including employment reference and property ownership documents). What do you advise I do? I am so pissed at the fact that these are infinitesimal issues. Imagine being on vacation and this is the bomb dropped on the very first day you arrive at an exotic destination - that’s my situation right now. It means no rest smh. I want to reapply immediately, if possible, because Easter is only some weeks away. In essence, should we have left the bank statement out in the first application (cos mine was enough since I’ll be fully sponsoring)? And, should I leave it out in the next application (just submit payslips)? I’m just confused even. Finally, please how do you go about it when monthly expenditure is higher than your monthly income?
