Your post is very very misleading. Brokers lack the capacity to undertake due diligence of property, they can only recommend. Brokers can't protect buyers from fraudsters, that is the unfortunate truth.

Brokers get you deals that favour you and is profitable to them.
Surveyors pick coordinates and inspect to be sure its not under government acquisition.
Lawyers undertake due diligence and documentation.


Guess you didn't read the post. One of the duties of estate brokers is to protect the interests of buyers. In Nigeria, estate brokers ain't too recognized, but they are independent bodies under which estate agents fall. If you say estate brokers are not obliged to protect the interest of buyers from impending fraud, then why did you say estate brokers brings deal that favor buyers. Moreover in Nigeria, the work of an agent is mixed with broker.

One reason why some people fall victims of real estate frauds is due to lack of due diligence in investigating a licensed real estate broker. As a result of laziness, you rather place a unilateral offer to the public, indicating that you need a property, but it doesn't work that way.

At this point, the antecedence of property brokers must be ascertained before you engaged them. The previous records and successes. Also enquire the previous efforts they have put through, to ensure that their previous clients didn't fall prey of fraudsters. We have ours. Now if you are satisfied with them, you may go ahead with them. However, if they are investigating or buying properties for you, always request a written search report to show they did it, so that they will be held responsible for any loophole, in case.

A lot of Land sale adverts and posts have swept off the internet by self acclaimed Estate agents and companies with juicy offers and cheap prices. In the circumstance, prospective buyers are in a bid to procure the land unverified. May i relate with you that once you make your payments, the estate companies with default land documents then move to the next available victims, leaving you to engage in unwarranted expensive court litigation.
Before you engage in a landed transaction, make sure you secure the attention and legal advice of a real estate solicitor to help in negotiation, search, verification, and probably proper execution of your final documents. Dont be appeased by a mere receipt as its inissible in court as a proof of title to land. Is it all the duplexes that are being sold for 130 mill? Has the interior been plastered and fully finished? How many rooms are in each apartment? By the way, this is a terrace building not a duplex.

Fully completed sir. All is 130M, not each. 4 bedroom in each apartment, plus 5 toilets. One attached to each bedroom and the other one, visitor's toilet downstair.

• Search at the Lands Registry – The Land Instrument Registration Law of each State establishes a land registry for the State, where documents relating to land within the territory are kept, and it varies from one State to another.

• Search at the Corporate Affairs Commission (CAC) – This is necessary where the vendor or past owner is a company incorporated under Companies and Allied Matters Act. Apart from the searches at the land registry, there should be a further search at the CAC to reveal whether or not there is an encumbrance or any charge whatsoever on the property.

Companies are required to file annual returns yearly with the CAC which is always accompanied with a company’s financial statement; the financial statement will reveal the company’s assets (where there are any) as well as any charges or encumbrance on same.

In Nigeria, one of the means by which a person can get a proper title to land is by obtaining Governor’s consent in respect of the land. The Land Use Act is the statute which regulates land and any transaction relating to it in Nigeria.

Section 22 of the Act provides that “it shall not be lawful for the holder of a statutory right of occupancy granted by the Governor to alienate his right of occupancy or any part thereof by assignment, mortgage, transfer of possession, sublease or otherwise howsoever without the earlier consent of the Governor first obtained. Usually, it is the duty of the holder of the right of occupancy to get the consent, but in practice this is left to the buyer. In Lagos, Nigeria, the country’s commercial nerve center, this practice has been embraced over the years. A burden usually conveniently ed to the buyer.


Obtaining Governor’s consent is a way of complying with the provisions of the statute and a way of protecting the legitimacy of the purchaser’s title to the land. Failure to get this consent can make the transfer of interest in the land null and void.


In conclusion, when the Governor’s consent is duly obtained by the seller after a transaction, it will serve two main purposes; as evidence of ownership, and there will also be security of his title.

, that Governor's consent is not necessary in a situation where the land is not situated in urban areas. If it is in rural environment, the consent of the Local government is essential.
