The Federal High Court, Abuja Division has issued form 49 against Engr. Mavilious Omobayo, the imposed deputy governor by Governor Godwin Obaseki.

The Court issued the Form 49 given AN ORDER COMMITTING ENGR. MARVELLOUS OMOBAYO GODWINS to Prison for having disobeyed the Order of this Honorable Court made on 17th July, 2024 to wit: (1) THAT A DECLARATION OF THIS HONOURABLE COURT is Hereby Made that within the meaning and/or intendment of the provision of Section 188(5), (6), (7)(e), (b), (, (9) & (11) read together with Section 36(1) of the Constitution of the Federal Republic of Nigeria, 1999 (as amended), the Plaintiff's action of filing a suit at the Federal High Court Abuja.

Edo Crisis: Shaibu Slams N50Billion Suit On Obaseki, Others

The Edo State Deputy Governor, Rt Hon Comrade Philip Shaibu has instituted a N50Billion defamation and contempt of court suit against the State governor, Godwin Obaseki; Commissioner for Communication and Orientation, Chris Nehikhare, and Crusoe Osagie, Special Adviser on Media Project.

Shaibu disclosed this to newsmen while reacting to his reinstatement by the Federal High Court, Abuja, saying that the court judgement that reinstated him was declarative and must be abided by.

He added that the judgement perpetually restrained the State Government and its agents from preventing him from performing his duty as the only Deputy Governor of the State.

He said, the judgement also added that the position of Deputy Governor by the relevant Sections of the Constitution of the Federal Republic of Nigeria was never vacant.

Said Shaibu: “I am not surprised that Nehikhare and Osagie were insisting that I remain impeached. They insisted so because they don’t read and study the court judgement before sending out their responses, which is their mode of operation.

“The judgement reinstating me was declarative and has to be carried out before an appeal over the matter could be heard, while the stay of judgement execution filed by the State cannot see the light of the day until the judgement is executed.

“I have already instituted a N50 billion suit against the Governor, Nehikhare and Osagie for defamation. They will be served next week”.

Shaibu, however, alleged that the gun attack against him was an assassination attempt orchestrated by the Governor of the State, Godwin Obaseki.

He denied the claim that he planned the attack that took the life of Inspector Akor Onuh at the exit of Benin Airport.

Stated he: “I was taken aback by the attack. In the last one year, I have refused to call for a protest to avoid confrontation with the State Government and their agents.

“I can tell you that Thursday’s attack was planned by the State governor to assassinate me. The Governor vowed to destroy me when I remained resolute to vie for the position of Governor.

“They said I was the one who planned the attack but I came in peacefully from Abuja to the State capital. Why were the armed thugs laying ambush for me? Were they expecting a visitor?"

EDHA appeals judgement upturning impeachment, files for stay of execution

The Edo State House of Assembly has appealed the judgement by Hon. Justice J. K. Omotosho of the Federal High Court, Abuja, which set aside the impeachment of the State’s former deputy governor, Philip Shaibu.

The State Assembly has also filed a stay of execution on the judgement pending appeal.

The Edo State House of Assembly, had on Monday, April 8, 2024, impeached Philip Shaibu following the adoption of the report of the seven-man investigative set up by the State Chief Judge to probe allegations of misconduct against the former deputy governor.

The investigative set up the EDHA was headed by Justice S.A. Omonua (retd.) and probed Shaibu on allegations of perjury and leaking of government secrets, ending its sittings with the former deputy governor refusing to appear before it.

Shaibu was impeached by the vote of eighteen out of 19 of the Assembly present at plenary, while one abstained from the headcount and voting process.

Recall that the State Governor, Mr. Godwin Obaseki, had upon the impeachment of Shaibu picked Omobayo Marvellous Godwins as his deputy to complete his second tenure in office, which lapses on November 11, 2024.

Federal High Court declares Shaibu's impeachment illegal

...orders IGP to immediately restore his security as deputy governor

A Federal High Court sitting in Abuja,this morning reinstated Rt. Hon. Philip Shaibu as the Deputy Governor of Edo State, following his earlier impeachment by the Edo State House of Assembly. The Court presided over by Hon. Justice James Omotosho held that the removal of the Plaintiff, Shaibu from office as Deputy Governor of Edo State and the subsequent appointment of Omobayo Godwins as his replacement by the Governor of Edo State was illegal, unconstitutional, null and void.

The Court held that there was a breach of the provisions of the procedure laid out in Section 188(1) to (9) in the way and manner the impeachment process was conducted. The court noted that the ouster clause in Section 188(10) limiting the jurisdiction is not a stand alone provision. The Court referred to the decision of the Nigerian Supreme Court in Inakoju v. Adeleke(2007).

The court therefore ordered the 1st Defendant, the Inspector General of Police to immediately restore the security of the Plaintiff as Deputy Governor of Edo State. At the time of filing this report ers of the Plaintiff were seen within the court premises celebrating the court verdict. The court held the impeachment was politically motivates, because of his aspiration to contest the office of Governor of Edo State.

BREAKING: EDHA Begins Impeachment Process Against Edo State Deputy Governor, Philip Shaibu

The Edo House of Assembly has commenced impeachment proceedings against the state deputy governor comrade Phillip Shaibu.

At resumption of plenary on Wednesday, the Majority Leader of the House Charity Aiguobarueghian, announced the impeachment notice revealing that the petition dated March 5, was signed by 21 out of the 24 of the house against the deputy governor which is more than the two-third requirement stipulated in the constitution.

The speaker Blessing Agbebaku acknowledged receipt of the petition and directed the clerk, Yahaya Omogbai to serve the impeachment notice on the deputy governor with a seven-day ultimatum to respond to the notice of impeachment.

Addressing the press after plenary, the Majority Leader, Charity Aiguobarueghian announced the petition was based on two grounds of perjury and revealing of government secrets.
