In recent times, what has been trending on the news is the arrest of Justices of the Supreme Court and other judges. As usual, the action of the DSS has sparked off heated arguments about the justness and unjustness of the act. It is my submission that the DSS, by arresting the Judges, in that manner, is not outside the armbit of the Nigerian Jurisprudential boundaries. Although the NJC is the institution mandated for the discipline of judges, it has slept on that constitutional responsibility, either as a result of being overwhelmed by the corruptness of the system or by feeding fat from it. It could be justifiable for the DSS to help them put its house in order, and as such, they should not cry over that which they have brought upon themselves. "The question now will be whether in the circumstances, the arresting agency should have followed the laid down procedures of inviting the judges" The answer would be that although Politically Exposed Persons (PEPs) and VIPs are usually to appear before investigating agencies, the DSS has made it clear that it was a sting operation. We must note that, this is one of the derogations to the Right to personal liberty. (See Section 35(1)(c) and (f) CFRN 1999). And so, the action of the DSS becomes constitutional by the express provisions of these sections,thus,mooting the option of adherence to the procedures of invitation or procurement of an arrest warrant from a court of competent jurisdiction. Public policy will also favour the act of the DSS as it has reposed some level of confidence in the citizenry regarding their hope in the Judiciary. It is instructive to note that the "Sting Operation" was not carried out against the office of the judges but against the individuals occupying and abusing that office. It is also to be noted that by the act of the DSS, the supremacy of the Nigerian Constitution has been restated, so also is the immortal words of Thomas Fuller, over 300 years ago "Be ye howsoever tall, ye are never taller thañ the law". I therefore suggest that, state of emergency be carried out on the NJC, NBA and the Bench as a whole. Investigation by the DSS on this case will reveal all those who aided, abetted, by omission or commission in any way possibly, to the rot in the system. That anyone found to have aided or abetted in any way possible, be relieved of his work to face prosecution and possibly, conviction. Including the Justices. Trashy article hastily put together!! Sting operation indeed!!! Why don't they go to Sambissa and conduct their sting operation there. It seems you don't know the horror of having armed men surround your home in the dead of the night. So many things'd be going through your head: are these robbers, has there been a coup, Fulani herdsmen, or worse still kidnappers??. The executive has really goofed up this time and they need to be called out. Mind you, this is not the DSS's first time of conducting such gestapo operations. Last year, they invaded Akwa Ibom's govt house. This year they invaded Ekiti's State House of Assembly. And now invading judges' home in the middle of the night. Look, we aren't saying the judges aint corrupt. If convicted, I don't care if they spend the rest of their lives in Kirikiri. All we are saying is that the rule of law must be upheld and duly followed. No one is above the law...not me, you, the judges, DSS or even Mr Buhari. The best the executive should have done is to push for judicial reforms. If the bench is corrupt, fine go ahead and push 'anonymous' wiretaps, video recordings and other evidence before the public domain...and see what will happen. 1 Like |

OP, you are on point. Any security agency can be tasked/empowered by the president to arrest any criminal. Even in the United States, the greatest democracy, SSS, FBI etc arrest judges who involved in bribery and corruption.
