The Court cannot interfere in a matter that arose out of the internal affairs of the Senate or any Legislative body. The Constitutional principle of separate of powers dictates that. Why any arm of government is acting within its constructional functions,no other arm of government can stop the function. In this case, the Committee''s duty to look into issues that arose during the plenary or sitting of the Senate. The only way the Court can come in under the principle of checks and balances is to subject that function or action of the Senate to review, after the action has been completed. That is what judicial review is all about. Judicial review does not prevent or restrain an action of an arm of Government from being carried out; it only subjects the function to review after it has been done, whether it is legal or done according to law and due process. That is why it is called 'review', which means being viewed or reconsidered again. It is not a judicial 'pre-view' that would have been to consider an act before it it is done. |

The judge who gave this injunction should be sacked. What are we doing to our future? Let her go and face the ethics committee of the Nigerian Senate which she is a part of. Why is she afraid of being asked questions about her allegations? And why didn't she report the sexual allegations to the authorities if she didn't trust the Senate itself? instead of defaming another member (the Senate President for that matter) on live television. This whole mess ridicules the Legislature as an arm of the government, making other countries around the world to take Nigeria as a joke. Are we saying she should rubbish the Senate and not be probed. |
