You will need to do another evaluation through WES US. The evaluation for Canada PR only useful to get Canadian equivalent of your credentials. WES will have to re evaluate your credentials to US equivalent. The good news is that WES already have your credentials and they have validated them through your schools while evaluating for Canadian equivalent. Thus, this evaluation will be faster this time around.

You don't have to send the evaluation report directly to USCIS through WES. The report should be sent to you and you can send a copy to USCIS when they request it.

Just asking and venting: Is this route still a viable option for anyone at this point? My date is 27 June 2023. With this snail-paced progress, when will it ever get to one’s turn? And even when it finally does, we still have the millipede-speed delays of the Lagos consulate to deal with. So I ask again, is this route truly viable anymore? So much money has been spent, and yet one is stuck. Age isn’t exactly on my side anymore. It’s frustrating and sad.

It's sad really . It's so cloudy and no one can predict anything at this point .

I think the frustrating thing here is not knowing the actual cause of the delay. If only they(embassy) could atleast say the reason.

I have gotten ission for a 2nd masters in USA , I already have a masters in Uk. The thing is that my Eb2 was received June 7, actively reviewing June 10. I live in Uk and don’t know if I should carry on with my F1 interview schedule for next week or cancel it?

If you a can afford I advise look through migrating to other countries with less backlog for a postdoc or research post still within your proposed endeavor & then change consulate. Right now you are looking at 2-3 years from Nigeria; whereas if you’re in London, for example, you could move this year.

Although many argue that submitting i-140 shows immigrant intent, however, majority claim that only filling I-485 or IVP show immigrant intent. Therefore, at your interview it may come up that you already have an immigrant intention which violates F1. your lawyer immediately.

On other note, for a PD of June 2024 to be current on FAD you are looking at FY2027/2028 so that’s a long wait ahead you might want to reevaluate your plans.

1. The priority is as slow as it is in Nigeria now but the advantage you get when you are in USA is that you can fill for EAD/AP when your DOF is current even though FAD is not current (for reference the DOF is currently on 1 Aug 23 while FAD is on 1 Apr 23)

2. You don't need to go back to Nigeria, infant most EB green card doesn't require interview if you are in the state.

3. For EB2, they are currently at 1 Apr 23 and yes if you are in USA you will have to wait at least until your DOF is current. The reason why it's very slow is because there are many people that applied for Eb2 in 2022 and 2023 but I expect it to move faster during Trump istration because they rules for EB2 has become a lil bit stricter.

No, only when their PD becomes current in DOF.

This is very tricky.

Technically, you can switch to Adjustment of Status by filing form I-485 with USCIS AS SOON AS YOU ARRIVE. Then you write to NVC to inform them that you are switching. You files will be switched to Adjustment route. The timeline for this I don't know for now.

You will notice I said it's tricky. This is because visitors visa are single intent visas. This means they were given by the embassy with your promise and intent that you will return to Nigeria after your visit. Also, at point of entry with visitor visa, the CBP will ask you why you are coming to the US, you will mostly likely lie that you are coming for a visit/ tourism etc. so that they can allow you into the country.

When you file 485, the USCIS can use that lie against you that you lied to CBP especially when you are already DQed in your immigration journey.

Then,I said you must file 485 as soon as you arrive. This is because you don't want to run into overstay before you file 485 to avoid another problem with overstay hurdle.

If you are ready to risk lieing to CBP, you can go ahead but I will not recommend it because your green card can be denied because of this.

I am a DIY principal applicant for an EB2 NIW and recently submitted my DS-260 online through the Consular Electronic Application Center (CEAC) website after my I-140 has been approved. I have also paid the Immigrant Visa Application Processing Fees for myself and my accompanying family .

As I understand, I am required to mail my civil documents to the National Visa Center (NVC). Since I cannot these documents online, I have a few questions:

port Photographs: Are port photographs required to be included with the mailed documents?
Photograph Attachment: If yes, how should the port photographs be attached to the application packet?
Document Stapling: Should I staple my photocopied documents (such as port, birth certificate, etc.) separately for each family member, even though they will be placed in the same envelope?
I would greatly appreciate your guidance on these matters.
