The Court of Appeal in Abuja has ordered a fresh hearing in the legal battle over the disputed Kano Emirate involving Alhaji Nasir Ado Bayero.

The Appellate Court, in a judgment delivered on Friday, held that Bayero was denied fair hearing due to the shoddy manner in which a Kano High Court conducted proceedings against him.

Justice Mohammed Mustapha, who delivered the lead judgement, stated that the Kano High Court was unfair to Bayero by conducting proceedings without serving him a hearing notice to enable him to present his case.

Justice Mustapha held that all courts of law are bound to ensure justice for all parties by giving them equal opportunities, adding that the conduct of the proceedings against Bayero amounted to a travesty of justice.

Specifically, the Appellate Court held that Bayero ought to have been served with a hearing notice to allow him to present his grievances before judgment was delivered against him in what it described as a shoddy arrangement.

The Court of Appeal, therefore, ordered that the case be remitted to the Chief Judge of the Kano State High Court to be reassigned to another judge for expeditious determination.

Justice Mustapha did not award costs against the respondents in the appeal filed by Ahaji Ado Bayero.

Imagine the Judiciary making this childish mistake...... didn't the Judge read through the court processes and didn't he notice the absence of a proof of service from the Court's Bailiff?

What you dont understand is, imagine if there was substituted service because Bayero couldn't be served physically, Bayero has APC in his corner and the courts in their pockets. It is obvious that Bayero and all he has in is pocket is federal might bent of frustrating anything on the way.

This ruling shows that the appeal court is compromised and have decided to tamper justice with a retrial when its not needed.

, Bayero went to Federal high court and Sanusi/State govt went to state High court. Bayeros camp knows what its doing and found the flimsiest excuse to force the State high court to retry the case after they initially insisted the case is a federal one and refused to defend themselves in the state court.

Its possible there was substituted service and they are denying it while the appeal court believes them because they are all cohorts. Its just a legal/power game.

Lol, substituted service and an order of court for that was never filed, neither was it put before the Appeal court.

Didn't you read the judgment of the Appeal Court? It said that hearing notice was never served on the Respondents. If at all a hearing notice was effected on the Respondents then a proof of service would be filed in the court process.....but none was filed!

Now, that means that an exparte motion was never filed to serve the Respondents, neither was any motion granted by the court to serve the Respondents whether by wit of substituted means or in person.....the lower court failed to conduct proceedings in the right way!! EOD.

A law was ed by the Kano State House of Assembly and signed by the Governor of the State. The creation and istration of the Emirate Council is a State affair hence Bayero's grievance is just but emotions and not a legal concern.

The principle of equity requires fairness and integrity from all parties. It's quite ironic when those who claim to be victims of injustice end up displaying the same unfairness towards others. The situation with Ado Bayero reflects this inconsistency and is indeed unfortunate.

The Kano State Judiciary and House of Assembly will now grant him full fair hearing, and the case will still be decided in favour of Emir Sanusi at the end, thereby putting the case to rest finally.
Determination of Emirate matters rests solely with the state government and state judiciary, that is why the Federal High Court cannot do anything about it,

I spent two nights in Kano, and it felt like everyone there was begging—the hotel staff and the people on the streets.

Children are out of school, and the government seems completely indifferent. These kids are like ticking time bombs. Honestly, someone should just divide this country already.

I think Emir Ado Bayero is as good as gone...

He is just buying time.. Maybe, he can drag this till the current Governor's tenure lapses ..I doubt though.
