Hi guys
My story is sort of long but I really do need help, suggestions or assistance on what to do.
My petition is about to be revoked and I have been given 30 days to give good and sufficient cause to show why it shouldn't be revoked.
In 2016 my sister using my mum as the petitioner filed for myself and my brother. We didn't hear anything from nvc and we were hopeful. In 2019, my mum ed due to complications from covid in the US and I knew it would somehow affect our filing. In 2020, they said my petition was approved but I didn't get mail or letters from them until 2022 when they said Ishould submit my documents which I did. From nvc, my case was transferred to uscis and each time i checked for update, I was told to wait as they were gong through my documents and will get back to me. Now my sister just received a letter from uscis with the title NOTICE OF INTENT TO REVOKE. Just to add, my brother has been in the US since 2015 because he went through the study route while I'm the only one here in Nigeria but we are both still waiting for this filing to come through and we both received this letter of revocation.
They say humanitarian reinstatement is not available in instances where the petitioner has died prior to the approval of the petition and now they say we need to submit evidence in of the petition and in opposition of the proposed revocation. I don't even know what other type of evidence to submit as I'm not there with them.
In this case where the petitioner is no longer alive and we only have our sister whos is the sponsor, what can we do and how do we go about it? Im so confused right now, imagine waiting alone for 8 years and not being able to see your family or even your only parent alive just to get this type of response.
Your suggestions will really be appreciated. Thank you
Mention people like Taal17 and aestake they will be of great help to you.

First of all sorry about your loss. I can’t imagine how devastating that was, coupled with getting this NOIR revocation notice. I wish I had a lot of advice. I think the best bet is for your sister to assume sponsorship role and become your petitioner. But that will mean your visa class will switch to F4 which comes with a longer waiting time. But if there’s a way to reinstate the petition your late mom filed, then that will be awesome. You have to do a lot of research, the Facebook group the person above suggested is great. Also you can explore visajourney website to see if you can get valuable info. You can also get an immigration lawyer involved, Ofcourse that would cost money. Don’t give up. Wish you Godspeed

Not sure the sister is the petitioner. She may have been the co-sponsor because folks use their parents for faster movements. If they have already said no humanitarian consideration because mom ed on before i130 approval, she may ask her sister to assume petitioner. I don't know if that means fresh application of i130. But definitely longer wait time! The brother has been in the US since 2015, let him fall in love with a USC or LPR nao.
@Annichere, this msg is actually for you. You may involve an immigration attorney. Pls accept my condolence. Tough time and no much good news from your circumstances.

What would have happened if the mom died (the petitioner) and the case was already at the NVC waiting for interview call up.

Switching the petitioner might have been possible if the sister is a qualifying relative.

2009 or 2019.
Which final step?
State exactly what the mail said.
If your petition is yet to be approved, as an F4 you probably have another 10 years to go.

Then its still necessary to get humanitarian reinstatement . They will ask about the petitioner at the interview and at the border.
Petitioner must be in the US at the time of applicant's enry or is traveling with the applicant when they intend to move

Your story is a bit confusing. Ypu initially said you were told your petition is approved. Do you have evidence of that? How did you know that you were apprived in 2020 when you did not receive any mail or letter
Why did they ask you to submit again in 2022
after you were said you intiallyapproved in 2020.
Your case rest on if you actually received an approved petition.
Hopefully the links shared can provide useful tips.

Thanks everyone for the messages, the links shared and the suggestions provided. i really appreciate them all. My brother is already married to a USC so he's kind of sorted.
To answer your question, i see the confusion too and this is what happened.
After the filing in 2016, the first mail i received from nvc was in dec 2021 saying my status has been updated and that i should make payments and start submitting my documents which i completed in feb 2022 . When i was done with that, they sent a mail saying my case has been transferred to USCIS and that they will get back to me when they are done reviewing it. i didn't hear anything from them till now and in the recent mail they sent, i just saw that my petition was approved in 2020 which is news to me because i didn't know until now.
At this point I'm even tired, this journey has not been an easy one on me and right now, if it so happens that it get revoked then life goes on.

It is not your turn yet. They are handling PDs of 01 March 2008 for documentation and stuff.. and 01 August 2007 for visa interviews. It may take 2 to 5 yrs. Keep living life, marriage, education, and travel.

Sorry about your loss. This must be tough. You said your mom ed away in 2019 due to Covid complications. But Covid started late Dec 2019 into 2020 so when exactly did she ?
I ask this because the time matters. Have you found out from USCIS when exactly your petition was approved? The exact date. If it was before her death, you have a chance. If it was after her death, then there's a problem and you may have to consider other options for immigrating.

Then your petition was approved . You even got to submit documents on ceac site.
Did you get notice that you were approved?
Search for humanitarian reinstatement, like others said share your story on the Facebook site and on visajourney.com
I think you have a good case
Just search petitioner does after i130 is approved online
Google AI tool will tell you steps to do.
Just print and all records that show the petition was approved hopefully before your mum ed.
As you said though, you can always consider other ways of immigrating. Don't be concerned that you could be refused a visit visa. You want to visit family..the family you have and that's fine.
