It is the speaker who must declare the seats vacant but where the speaker fails to do that, the Judiciary must come in, to declare the seats vacant..

Now that the case has gotten to the courts, directly or indirectly, any judge adjudicating on any issue directly or indirectly related to the matter if the 27 lawmakers must declare their seats vacant.
So who is constitutionally empowered to determine if truly there is division in their party at the national level? Is it not the courts? Until the courts say otherwise, are they not still lawmakers? I wonder hoe people think their own interprettion of the constitution is superior to the interpretation of the courts.

The same constitution also allows defection by who have crisis in their political parties. Everyone who defects claim that there is division in their party. So what should happen? But the Supreme Court has defined what a division means.
There must be two National Chairmen.
There must be two National Secretaries.
There must be two National offices or secretariats..

People like Edwin Clark are misleading and giving wrong advices to the Governor. For goodness' sake, Edwin is not from Rivers State. He should leave our state alone and focus on Delta State.
If the Martin-led House Assembly denied that, they didn't defect to APC, the Defendant must prove that in court because court judgments are based on cogent and verifiable shreds of evidence, not media publicity or video clips.
To remind Clark, the so-called 3 illegal have been used by the Governor to an appropriation of 800 billion is been suspended by the entire house for gross misconduct. So their status is still invalid in the house because their suspension has not been called off.
So Edwin Clark should also cite the composition of the state House of Assembly in the constitution to ascertain the legality of the 3 ' house.
The court in his wisdom has given several judgments compelling the governor to represent the appropriation to the Martin-led house which he vehemently refused and still working with the illegal aliens. Our constitution didn't recognize 3 suspended House of Assembly.
Sir, kindly give good father, unbiased, and elder advice to the governor to do what is right and not to behave like a tyrant. Sir, with due respect, stop mingling from the Rivers crises by raising false allegations against the Honorable Minister who's doing well with his duties at the Federal Capital territory.

You're dead dead dead wrong!
No Court in Nigeria has given any judgement strictly on the defection of the 27, no Court has interpreted the section 109 till date, as regards to this current Rivers crisis.
What Justice James Omotosho did in January 2024 was to restrain the Governor and State government from interfaring with the activities and sittings of the 27 lawmakers, saying they were still the recognized lawmakers.
But on the issue of their defection, no Court has judges whether they have lost their seats or not.
And that is what I am talking about here..
That definite ruling on their defection.
They are delaying..
