My brother took a Loan of 1,800,000 from Sterling bank to complete the money he needed to purchase rice.

His warehouse was vandalized and 85bags of the rice was stolen. He couldnt meet up with the loan repayment after paying half of the money. He was still trying everything possible to commence payment

On Saturday evening, some armed police officers accompanied by a bank marketer stormed my office where my brother came to ask me for financial assistance and started beating up my brother. They tortured him till he became weak, chained him and took him away.

Before they left my office, they told my customers waiting outside that they should go collect there money that we are fraudulent people ( N:B, I'm into thrift collection business )

They kept him in detention for 4 days ( he got out today) . When my mother went to see/bail him, they detained her too and made her to borrow 200k from her friends over the phone to offset part of the loan .

The moment they got an alert, they pushed my mum out of the station.

They forced my mum and brother to sign some documents inside station, stating that they will be remitting money to the station every month

Now in the suit, I'm petitioning the ;
Sterling bank,
The branch manager,
NPF
And the marketer.

What's your thought? My brother is currently in the hospital getting treatment

This is Nigeria… they will win over you.

Use the financial strength for a court case you proposed to offset the loan.

Not always true. However he should get a lawyer who's very skilled at his job and very honest to advise him better.

If we look at this issue critically with an eagle eye lens and observing from a very close distance which can guarantee a clear and decisive analysis from a well trained lawyer, you will see that the Op's brother borrowed that money because of a woman who has been fvcked and mounted by many men.

Never struggle to please a woman who is not a virgin. You will end up in trouble and your family will end up in trouble.

Fvck any girl you want but when it comes to marriage, find a virgin woman. Only her deserves your love and devotion. Do otherwise and train another man's child thinking it's yours.

First clear the debt then hire a good lawyer to do the job provided you got videos and photos to backup your claim.

Oga, did the bank workers seize you brother, assault and detain him? I don't think so, the police did.
Can your say the police acted on behalf of the bank and so the bank should take responsibility? Don't think so also as the police officers are not employed by the bank.
The bank will simply say they reported a case as proper law abiding organisation to the police.
Can you sue based on them defaming your company by telling your customers not to patronize your thrift company? How do you prove that happened?
Anyway, that is my layman opinion, lawyers in the house will explain better.

If you can prove they did, then your brother ought to report them at the station for assault.
He can then seek monitary compensation to withdraw the case from being charged to court or during trial.

That's y the bank should have security over given loans , so if it goes bad, they can use that collateral to recover the loan... Nigerians really don't know their rights ... No one can ever go to jail for failing to payback a loan...only if the person issued a cheque... without that, nothing will happen

Lolz, I get what you mean.
If the police men came from eg afonka, Gowan estate etc stations and other stations in the area, and you feel they may be biased, you report at idimu area command that supervises them all.

Clear which debt?

First of all, they have no rights to use the police to beat his brother up. That is a criminal offense.

Second, they beat his brother up. That can be tabled as attempted murder, physical assault, and many other names under physical violence. Another crime.

Third, the petitioner should include all the financial losses they have incurred all the time that his brother was locked up and all the time that he was hospitalized.

It is the bank that should be paying him.
