Independent right of residence for spouses

(1) If marital cohabitation ends, the spouse’s temporary residence permit is extended by one year as an independent right of residence unrelated to the purpose of the subsequent immigration of dependants if

1. marital cohabitation has lawfully existed in the federal territory for at least three years or

2. the foreigner has died during marital cohabitation in the federal territory

and the foreigner possessed a temporary residence permit, permanent settlement permit or EU long-term residence permit up to that time, unless the foreigner was unable to apply for an extension in time for reasons beyond his or her control. Sentence 1 does not apply if the foreigner’s temporary residence permit may not be extended or if the foreigner may not be granted a temporary residence permit or EU long-term residence permit because this is precluded by a rule of law on of the purpose of residence or by an ancillary provision attaching to the temporary residence permit pursuant to section 8 (2).

(2) The requirement stipulated in subsection (1) sentence 1 no. 1 for marital cohabitation to have existed lawfully for three years in the federal territory is to be waived if necessary to enable the spouse to continue his or her residence in order to avoid particular hardship, unless an extension of the foreigner’s temporary residence permit is not permitted. Particular hardship is deemed to apply especially if the marriage is not valid or has been suspended under German law because the spouse was a minor when he or she married, if the obligation to return to the country of origin resulting from the termination of marital cohabitation threatens to substantially harm the foreigner’s legitimate interests, or if continuing marital cohabitation is unreasonable due to the harm to the foreigner’s legitimate interests; in particular this is to be assumed if the spouse is the victim of domestic violence. Such legitimate interests also include the well-being of a child living with the spouse as part of a family unit. In order to avoid abuse, extension of the temporary residence permit may be denied if the spouse relies on benefits under Book Two or Book Twelve of the Social Code for reasons for which he or she is responsible.

(3) In derogation from section 9 (2) sentence 1 nos. 3, 5 and 6 the spouse is also to be granted a permanent settlement permit if the spouse’s subsistence is ensured after the termination of marital cohabitation by maintenance payments from the foreigner’s own funds and the foreigner possesses a permanent settlement permit or an EU long-term residence permit.

(4) Without prejudice to subsection (2) sentence 4, claiming benefits under Book Two or Book Twelve of the Social Code does not preclude extension of the temporary residence permit. The temporary residence permit may thus be extended as long as the conditions for granting the permanent settlement permit or EU long-term residence permit have not been met.

It seems the office in Munich has not submitted the documents to the German embassy in Nigeria. Did your spouse submit all the documents that was required of him/her?

This is actually for my aunt. She’s still in Nigeria. Their two kids’ visas have been issued since but my aunt’s own didn’t come out successfully. She got that mail from the German embassy in Nigeria. We do not know what that means but that’s the English translation. Any idea what is wrong?

I just need clarity on these. My fiancé just submitted our petition last night. I’m not worried about how long it will take. I need to know what next to do as we wait. I read about vaccinations, is it required. Should I go ahead and do those vaccinations and which ones are required. I paid ihs and visa fee on 31st of August.
My biometric is scheduled for Wed 6th Sept and I have chosen the assisted service.
My questions are:

1. From what date to what date should I print my statement? I intend to show minimum of 30-31 days.
Someone said I should count 30 days before my biometric date, is this right or should it be 30 days before I paid visa fee and ihs?

2. Place of work is a school but its not showing "Active Status" on CAC website. Can I still use the reference and employment letters or I should look for another place of work which is ACTIVE?

3. Marriage certificate is showing my occupation as a teacher. Though my wife is not going with me for now but do I still need to the certificate to prove my tie here in Nigeria?

4. If the suggestion in question (2) is to get another company,  the position/role might  contradict that of "teaching" in question (3). Does this matter or not?

I thank God for this. I started this whole journey in June, though I already have my documents ready by then. It has been a stressful journey. I wrote an emergency English test because of discrepancies in my WAEC result; mistakes in my names and date of birth, my school arranged for a test and I ed.
Then my POF matured on July 27 but I waited for CAS till August 20. Thank God for everything.

Note: I updated my current address with Firstbank so that it shows on my POF, and also I used the FirstBank branch closer to me so their stamp shows I it’s within where I live. I don’t know if it helped but just sharing it to help those with fear of using FirstBank.

submitted my application last week and biometrics on monday. My IHS fee was showing 0.00 and when I clicked on pay, a reference number was rather sent to my email and the application continued.

It's been days after biometrics, would I still recieve an email to pay for the IHS when a decision is made, or?

You made a mistake while inputting your course end date. Don’t worry, they will ask you to pay when your visa is approved

Standard application is more faster than Priority lately. I noticed the trend of the result early this month. Most priority application not take more than 10working days and I've seen standard application getting to VAC in 4-5days. Something is wrong somewhere.

I would advice anyone trying to apply not to waste money in opting for priority application. Its a total waste of money.

This is fallacy of generalization. Note that everyone’s case is different from each other. A single person traveling alone might get a decision within 3 days depending on his/her case. Each and every member of a family will be scrutinized separately and individually, which might take longer time compared to others. The decision makers are not the same or just one person. So saying that priority payment is a waste of time because of few persons you know that got quicker decisions with standard application is not a good conclusion. No persons application is the same even if you are twins!

I did on Thursday and I’m not planning to call them, why do you want to rush them? Understand this is peak period

Please was your application successful? First Bank did not respond to the email from UKVI in my case. It appears that they have a problem. I ed them and they are telling me they have escalated to the proper unit and I should expect a call back in 48hrs. Time is far gone. Does anyone have a quick fix for this? I did my biometrics on the 18th of July.

I just applied last week and I also submitted a reference letter from FirstBank and I have been calling them everyday to check if a mail was sent to them from UKVI.
Did they acknowledge that UKVI sent them a mail but they didn’t respond in time?

For standard application, it’s 15 working days. Don’t count weekends and holidays.

I wonder why you are worried. For standard, the waiting time is 15 working days. Don’t compare people’s application with yours, your cases are different.

Good evening sirs & Ma, Please I just filled out my form and on getting to the IHS payment, I was shown a zero dollar ($0) to pay. As I clicked the continue tab, I got the IHS reference number which was automatically updated in my application. Now, my application has been moved to the next page where I have to pay for a Visa application.

1. Please, Is it advisable to proceed with the Visa application payment or do I need to cancel the entire application since I wasn't made to pay for IHS?

2. Should I proceed with the visa application payment, would I be able to pay for the IHS later time at TLS center?

Thanks for your reply, she did start transferring some of the funds to me earlier in the year to build my , but stopped after the exchange rate started climbing rapidly. The amount she transferred to me has depreciated already so that was why we decided to leave the amount in her in the UK.
What will you advise when it comes to time to apply for visa, should she still transfer it to me? And how do I then prove to the ECO that I got the funds cause I would then have to disclose that it’s from my sister? Is there a way of keeping the money so it remains at the pounds value?

I’m using FirstBank too. FirstBank actually reply mails within 24hrs, I don’t think the issue is from them. I heard that few months ago one of FirstBank branches in Ibadan was dishing out fake POF to people which affected the whole of FirstBank’s reputation. I think anyone using POF from FirstBank should get a reference letter from them to back it up. That’s what I intend to do though I don’t know if that will help my application. If you find any better solution pls do well to post it here.

Hello duchess90, justwise. Thanks for all you do here. I applied for Coventry University and got a conditional offer. After the deposit I was given access to the CAS Shield to submit by documents. I submitted my bank statement but it was rejected as according to them it had expired and I would need a new one.

This is already July 27 and I am working towards the September intake, what are the chances to still leave by September if I my new bank statement which will mature in 28 days - August 24th. With the school already saying their CAS deadline is August 14th

Yes this is true. So what did they say is the solution?

I think the issue with FirstBank is that there bank statements do not have any information for the UKVI to even them. So I suggest that if you are going to use FirstBank, request that they issue you a reference letter which I believe that will have details for ECOs to be able to the POF. That’s what I intend to do.

Hello duchess and all gurus, I need help. We had a visa refusal and were asked to apply for an istrative review. Here are the grounds for the refusal as shown on the screenshot. The truth remains that, the funds in the were dissipated while waiting; a part went debited for Form A. while the others got debited after the expiration of the 30/31 days. Please, the way forward?

Did you check the oanda rates as at the day you submitted your application to see if your funds were enough?
