The supreme court has upheld the 30-day prison sentence of Alex Okoh, former director-general (DG) of the Bureau of Public Enterprises (BPE), for failing to obey an order since 2012.

In the judgment delivered on Friday, the apex court also awarded N20 million cost against Okoh and BPE in favour of BFIGroup, a Nigerian-American consortium.

BACKGROUND

In December 2019, Anwuli Chikere, judge of a federal high court in Abuja, ordered the arrest and imprisonment of Okoh.

The judge accused Okoh of serial disobedience of the supreme court order over the ownership controversy of the Aluminium Smelter Company of Nigeria (ALSCON).

BFIG had won the bid to take over ALSCON in 2004 but was disqualified by the BPE under the leadership of Okoh.

In 2012, the supreme court declared BFIG the rightful winner of the bid for ALSCON but the BPE refused to hand over ownership to the firm.


BFIG initiated a contempt suit against the BPE and Okoh, its DG, for failing to obey the supreme court order.

However, despite being issued a notice of the commencement of contempt proceedings, popularly called Form 48 which stated the consequences of disobeying court order, the BPE DG refused to appear in court to answer to the allegations against him.

The federal high court held that the continued refusal of Okoh to obey the supreme court order was a fundamental violation of the rule of law, which portrayed the government as lawless.

In January 2022, the court of appeal upheld the judgment of the federal high court.


APPEAL AT SUPREME COURT

Dissatisfied with the court of appeal decision, the BPE filed an appeal before the supreme court.

However, the appeal was dismissed on Friday.

Aside from the N20 million fine, the apex court issued an order of perpetual injunction restraining BPE from going into any negotiations or contract with any other investor over the sale of the federal government equity in ALSCON.

Also, the court ordered the immediate sack from the plant of UC RUSAL, a Russian firm, that the BPE handed over the plant to after cancelling the declaration of BFIG as winner of the bid.

Meanwhile, early in January, President Bola Tinubu sacked Okoh from office as BPE DG

There was confusion and disquiet, yesterday, as two Federal High Courts, in Abuja, issued conflicting orders on the political crisis in Rivers State.
One court nullifies 2024 budget, another orders parties to maintain status quo.

Earlier in the day, a Federal High Court nullified the Rivers 2024 Appropriation Bill of N800.3 billion that had been ed by a faction of the House of Assembly, led by former Speaker, Edison Ehie, and signed into law by Governor Siminalayi Fubara. It ordered the governor to re-present the budget to the Mr. Martin Amaewhule-led House.

However, a few hours later, another court ordered all the parties in the matter to maintain status quo, pending the determination of an ex-parte motion that six elders of the state filed to stop Governor Fubara from re-presenting the 2024 budget before the Amaewhule-led faction of the Assembly.

Justice J. O. Abdulmalik ordered substituted service of the application on all the defendants, and adjourned the matter till February 28, for hearing.
The plaintiffs in the matter led by a member of the Rivers State House of Assembly representing Bonny State Constituency, Mr. Victor Jumbo, are Senator Bennett Birabi, Senator Andrew Uchendu, Rear iral O. Fingesi, Ann Kio Briggs and Emmanuel Deinma.

They had through their team of lawyers led by Mr. Olukayode Ajulo, SAN, prayed the court to declare the seats of 27 lawmakers in the state that defected from the Peoples Democratic Party, PDP, to the All Progressives Congress, APC, vacant.

Mr Nwanosike said Mr Fubara’s alleged move was to discredit and force the immediate past governor of Rivers and current FCT Minister Nyesom Wike, out of office.

The chairman of Ikwerre Local Government Area in Rivers State, Samuel Nwanosike, has accused Governor Sim Fubara of orchestrating the incessant kidnappings in the Federal Capital Territory.

In a video on his social media handle on Sunday, Mr Nwanosike said Mr Fubara’s alleged move was to discredit and force the immediate past governor of Rivers and current FCT Minister Nyesom Wike out of office.

“He is paying people to go and tell Abuja that Wike is playing politics in Rivers state that they are doing kidnapping in Abuja,” the Ikwerre chairman told thousands of his ers at Omerelu community in the video.

It means that Fubara is part of those ing the kidnappings in Abuja because he wants Nyesom Wike to leave office. Nyesom Wike will not leave office. Foul!” Mr Nwanosike told his ers, who responded with excited screams of “foul.”

Mr Nwasonike, who also alleged that the governor had yet to record any achievement since his assumption of office, said since Mr Fubara was paying Chijioke Ihunwo, the chairman of Rivers Youth Council, to insult the FCT minister, he would also continue insulting the governor.

Fubara is a foolish governor because since he took office May 29, he has done nothing for Rivers people,” said the LG chair.

The local government chairman claimed President Bola Tinubu would not succumb to Mr Fubara’s cheap tactics to remove Mr Wike from office as he is happy with the latter’s performance despite the increased insecurity in the nation’s capital.

“Tinubu is aware of who he appointed, and I’m happy that Tinubu is happy that Nyesom Wike is delivering in the service of democracy,” he stated.

Joe Johnson, Rivers commissioner for information, told Peoples Gazette that he was not aware of the allegations as he was “only hearing it now” but that he would react when he can confirm the statement.

Meanwhile, Mr Wike had, last week, said the exacerbated kidnappings in Abuja were the domino effect of military incursion in Kaduna and Niger states, which had flushed out many bandits from the region.

Messrs Wike and Fubara had been at rift over the affairs of the state until the president intervened and came up with a resolution with conditions favouring the minister.

The video of a local government chairman in Rivers State calling the state governor, Siminayi Fubara, a “foolish governor” has emerged online.

The video, which has since been eliciting reactions from Nigerians, showed that the local government chairman made the statement while addressing some of a political party in Rivers State.

The chairman, in the video shared on social media by Emma Ik Umeh on Sunday night, said: Today, Fubara is a foolish governor, he is not a mumu governor, he is a foolish governor.”

Amaechi, has urged Nigerians not to flee the country in what has come to be known as ‘japa’ syndrome, stressing that there are abundant opportunities in the country. Says it’s easy to become a minister or governor in Nigeria.

 “I have always discouraged those who want to leave the country. You can always get 9a.m. to 5p.m. jobs when you leave the country but you can never get the kind of opportunity you get in Nigeria.  You can just wake up and you can become a governor or a minister in Nigeria,” Amaechi explained.

Speaking on the quality of leadership in the country, Amaechi said: “Nigerians get what they want, what they deserve. You don’t complain after. You don’t. Nigerians at all times have had opportunities to vote. So, whatever you voted for is what you deserved. But, let’s not go into politics.”
