The lawyer may have just been interested in taking money from you. That law is for EXTREME/EXCEPTIONAL circumstances, even at that VERY DIFFICULT to get. Having a child is no reason not to meet the financial requirements. I don't believe you have any chance of appeal. The spouse visa thread helped me a lot when I applied, study the thread. The UK spouse needs a job or the required savings, there's no way out.

A fair refusal means you do not meet all of the requirements for the visa. Your refusal was not because of an error on their part.

Hello everyone, please Is there anyone that applied for spouse visa and re-appealed, and the appealed was allowed, the UKVI ed me to submit my port and also do another Tuberculosis test, that the decision was overturn. So I submitted both port and Tb test on the 31st of May,2022. But up till now, I am yet to get from them. Do anyone have an idea how long it takes for them to respond? I was at Tls some days ago and I was told to keep checking my email… but it’s frustrating… will be glad if anyone can assist. Thanks.

Did bio aug 6, got rejected jan 23rd because of birth certificate, they said i ed my birth certificate late. So they grant me permission to appeal,since feb 15 that i appealed I haven’t gotten any news from them.

When you appeal ,you will be notified if your appeal is granted or they want open appeal ( open appeal means your lawyer will go against their decision on ur behalf in court) after 4 weeks you will get a reply from your lawyer if your appeal is allowed or not.

I don’t know if sending a paid email would help, maybe you should look into it but if it doesn’t, then you just have to wait it out, meanwhile, congratulations on the decision that was overturned in your favour, hopefully you will get your collection email soon.

I was denied spouse visa January due to lack of the specific funds needed to be in my , which i appeal againat and its was allowed in may but haven't been ed since then ,can anyone walk me through on how long i have to wait for ,thanks in advance.

My wife and son went back to the uk January 2022 and had a stop over at Amsterdam without any transit visa but they are both British tho so don't understand this anymore.

I think you are right, I read most of the past 3 years on this forum, and most people with appeal process did take the length of time for everything to go through. I think the longest bit was the returning of the port after winning appeals. I hope it isn’t the case anymore though, but people can only share their own personal experiences on here, they are not here to make people feel sad or dejected.

If u wanna appeal a decision, when you file in your appeal its take 3weeks before they decide if they will have a change on their decision or its will be open appeal, open appel means you guys are going to court. u will wait another 3 weeks to get a court date ,then you will have to wait 4 weeks to get your decision if you win your appeal or not.so if you win appeal you will have to wait for 8 weeks or less before you can get ur port but don't forget again some people get grace way dey speed up anything.

I could writing here about my spouse visa that was denied and i ask opinion about appeal and i didn't get a good or ing reply on here but i didn't let it affect me,i can now tell you guys that my appeal has been allowed and a guy was telling me then that appeal takes 2 years lol,all thanks to God.

@Aliyu40 thanks for the reply, the Immigration lawyer who put in the application for us as at then did confirm its in d Immigration law and she did quote the law in the application as well and please can you try and expanciate more on what you mean by fair refusal.

However, I am not satisfied that you are receiving one of the existing sources of third party listed in Paragraph 1(b)(i)- (iv) of Appendix FM-SE. Therefore, you cannot rely on third party to meet the financial requirements of Appendix FM and any prospective financial you have available to you in the UK cannot be taken into .
I note that you have provided Access bank statement in your name which show minimum funds of 9,687,953.72 NGN (£16,402.60) held for 6 months prior to the date of your application. However, this is not sufficient to meet the financial requirements. I therefore refuse your application under paragraph EC-P.1.1(d) of Appendix FM of the Immigration Rules. (E-E.3.1)
