Wow! Looks like you have a good case. Did you explain all these in your previous applications? I'm sure it's because of people like @solarium 's 3 friends grin that the rate of refusal is high.

Ok, but the tone of your response prevented me from keeping an open mind. Didn't you even say your friend was going to be arrested? It must have in the least been on the suspicion of a crime which he didn't defend. No offense, but that story is a little far-fetched... Moving on

Read with open mind,it is not automatic if all the requirement are not meet,but I can tell you once the requirements are meet it becomes automatic provided you have no CRIMINAL RECORD.

@justwise I'm just looking at @sholeola23 situation - does it count that his immigration offense was committed largely while he was a minor and depended on other people to make decisions for him? Dude spent his entire life in the U.K. o! He probably just needs to appeal and explain why he should not be held responsible for an offense he probably didn't even know he was committing, being a minor. Although he has had a few years to regularize after becoming an adult, but, I must say it's a really dicey situation. Not entirely a worst case scenario, is it?

Is either you are lying or your friend is because the UK police will never say that, they will personally call the ambulance and make sure you are treated before taking action on your case. I know a made-up story when i see one.

My point is regarding your initial comment that the visa is automatic regarding his immigration offense.


EEA visa supersedes non-EU member spouse visa application, you don't even pay for it let a lone pay for NHS or the tough financial requirements.

Work permit is far more easier and less requirements compared to spouse visa and the visa is 3 or 5yrs unlike spouse visa which is two and half years with endless documents to submit.

The reference number is not recognized until a decision is made. Keep trying. I think most applications submitted about the time you did yours are delayed. I've read about two others with similar delays on this thread, mine inclusive - although I got a mail apologizing for the delay.

Only you, 3 of your friends are immigration offenders? Plus including you? Lol. grin Seriously though, just wondering the moral of your little story...Won't be surprised if immigration reforms begin to change the rules with scenarios like this. Please let's keep it positive out here. I'm also aware a spousal settlement visa will override previous visa application refusals, but I didn't think it is AUTOMATIC. Several people have been denied for several reasons, it would be foolhardy to think it is automatic upon marriage. Anyways, what do I know? I'm just a short stay visa hopeful.

Says who? comment base on what you know,I have 3 friends who had same problem and they are all legal resident in UK today with the latest having his status regularized about 6yrs ago.....One of them was even arrested at his wirk place,he was injured when been arrested,the police told him to ho and get himself treated,he ran away and never showed up,he meet his wife who is a citizen,got married and filled while he was in UK,he was asked to exit the country before anything could be done,he left and was cleared by the home secretary in (5 months and some few day's......Tellme if there is any other visa that supersedes settlement visa aside from diplomatic visa?

I'm sorry if you feel insulted but I'm certain I didn't because I had no intention to insult you. The statement I made is a fact that applies to all including me. I'm actually surprised to see that people do not see tax remittance as serious and advantageous to the visa application. For the record, tax returns are filed by companies on behalf of their employees as stipulated by law so it's not for business owners but for anyone working in a country. Like I stated before, I have my electronic tax clearance certificate (E-TCC) card and remittance records. It's my right and the company's obligation.

So is pensions deductions and remittances. Your right, as well as the company's obligation, but do you include proof of compliance in your application? The fact remains that the documents submitted need to be relevant to your application and no one has still been able to convince we "naysayers" of the point of a tax certificate/returns for an EMPLOYEE. For an employer/self-employed of course you need to prove the status of your business and such returns will assist, but it without doubt does absolutely nothing for an EMPLOYEE so, for someone to because he/she works/worked at VFS/TLS blatantly trying to discountenance something as simple as this needs to be corrected, more so as there's the caveat that visa collection office/officers are JUST THAT. Not because it matters if or not you include the pointless, unnecessary document, but because we need to educate ourselves. PROPERLY.

Anyways, kudos to you and everyone contributing here, very much appreciated, I randomly follow the thread every now and then and have to it it's great stuff! Stay blessed!

I've been following this argument silently since yesterday, the issues to the reasonable are quite straightforward, however, I have a question for you travelland, seeing your attempt to highlight tax returns in the picture you posted? Do employees in Nigeria file tax returns? And are tax returns the same as tax clearance certificate? The answer is NO. Tax returns are filed by companies and needed as proof for a BUSINESS OWNER, however, this requirement does not apply to EMPLOYEES. Come on people, this is simple logic!
