Supreme Court Begins Hearing Of PDP, Ihedioha’s Application On Imo Judgement

The Supreme Court is hearing the application filed by the Peoples Democratic Party (PDP) and its candidate, Mr. Emeka Ihedioha, over the January 14, 2020 judgment which sacked him as the Governor of Imo State.

Mr. Ihedioha and the PDP, in their applications, claim that the judgment of the apex court which installed Senator Hope Uzodinma as the Governor of Imo State was obtained by fraud.

They are therefore praying the seven-man of the apex court to review and set aside the judgment.

The , headed by the Chief Justice of Nigeria, Tanko Muhammed, is currently hearing the application.

Lawyer to Mr. Ihedioha, Chief Kanu Agabi, in his argument, claims that fraud is evident in the judgment, as the appellant, Hope Uzodinma, claimed he was excluded from 388 polling units but tendered results from only 366 polling units

He adds that with the addition of votes from 388 polling units in favour of Senator Uzodinma exceeds the total number of accredited voters by 129,000 votes.

Countering the argument, Lawyer to Senator Hope Uzodinma says the application to revisit, review or set aside the judgment of the court is an incompetent one lacking in merit.

He argues further that the apex court lacks the jurisdiction to sit on appeal over any judgment delivered by the court except where cases of typographical errors or slips are noticed in the said judgment are established and in this case, no such errors have been established.

Mr Damian Dodo adds that the appellant approached the apex court in the face of compelling evidence that Senator Hope Uzodinma won the election, and therefore, has asked the court to dismiss the application.

Supreme Court has stood down Emeka Ihedioha’s application after listening to arguments from all the parties.

The apex court will deliver judgment by 3pm later today.

Former President Olusegun Obasanjo says the country must address the issue of restructuring in order to prevent a serious problem.

Obasanjo said this at the first memorial lecture Fredrick Fasehun, founder Oodua Peoples Congress (OPC), in Lagos state, on Saturday.

The elder statesman, who added that the country could not afford another war, said he would keep fighting for the country until he dies.

“I will continue to fight for Nigeria’s unity until I die. But this fight is not to make my children and my race second class citizens,” he said.

“When I was elected president the agitation was true federalism but now it is restructuring. If we don’t address it they may go from restructuring to self-determination and this will be a serious problem.

“If Boko Haram can get external , any group that decided to go will get from within and outside. So we must address the issue now.

AUTHENTIC ALSO POSTED: Olusegun Obasanjo House on Fire

“The language we are using to address ourselves across the region now is uncouth and it must not continue.

Frederick Fasehun- Founder OPC

Obasanjo stated that Nigeria belongs to all Nigerians on the basis of freedom, equality, equity, justice, fairness, peace, security, cooperation, mutual dignity, respect, shared values and shared prosperity.

“If these factors are removed, Niagara falls to pieces. But for now, we can still make hay while the sun shines”, he warned.

Obasanjo, in his lecture, who pointed out several calls by groups and prominent Nigerians on insecurity in Nigeria, the gave “apologists” of Buhari’s istration six questions to answer.

He quipped: “Are all these people speaking the truth enemies of the government? Are apologists just telling the President what they believe he wants to hear? Do they believe that they are being fair to Nigerians and indeed to President Buhari? Do they that there is a day of judgement when they have to render before God? I know for sure that God has the best in stock for Nigeria. And do they consider the present situation as the best for Nigeria?”

The former leader regretted that President Goodluck Jonathan’s efforts of a National Conference did not even get to the National Assembly.

“Today, the agitation has moved up to restructuring. Thanks to Buhari’s istration and its impunity and all. With the fractional political division, poor management of the economy, the non-protecting security and the politics of uncertainty in the land, we should not allow the restructuring agitation to degenerate to self-determination agitation.

“There is still a window of opportunity for us to nip in the bud a possible and indeed likely agitation for self-determination that will be violent, destructive and all-empowering. We have descended to lack of civility bordering on uncivilisation, indignity, mutual disrespect and crudity in the language of our debate, dialogue, discourse, address, comments and remarks across tribe, section, religion, region, ethnicity and community. If not halted, it will degenerate and poison the atmosphere to the tipping point or point of no return. If the issue becomes conceptualised as an issue of freedom or liberation, there will be no wall or gate to effectively prevail against it. Some well-meaning Nigerians are worried and understandingly so.

“Threats and intimidation do not build a community, they rather destroy. The language of love, knowledge, understanding, appreciation, consideration, comion, cooperation, forgiveness and accommodation should be the language to build our nation. We should be honest and courageous enough to tell ourselves home truth for self-education and for the edification of our country. If we shirk our duties to our country because we are afraid of threats, intimidation, blackmail or being called names, we are not worthy of being called patriots or nationalists.

“While the unity and integrity of Nigeria will be defended with all that I can muster but surely not at the expense of my liberty, human dignity, freedom of choice, and human rights. I will not relent by exerting effort, ability and capability to make a contribution to the development and progress of my land of birth. If I allowed myself to be enslaved in Nigeria, I would have left a shameful legacy for my children and their succeeding generation forever. May God forbid!

“In that way, my existence in life would amount to naught. “If the hands cannot be swung”, the saying goes, “they are better held above the head perpetually”. My services to my country and to humanity would have ended in total failure as I would have lived not to carry out the divine mission of making better what I found. If I fought racial and tribal injustice and oppression in South Africa, Angola, Mozambique, Namibia and South Sudan tenaciously and successfully, it would be remiss of me to do any less in Nigeria. It is a divine duty and responsibility which must be attended to, if necessary.

“It would appear that the National Assembly is fully aware of the lurking danger and wants to be proactive which is commendable. But the Nigerian Constitution does not give the National Assembly the power to write a new Constitution but the power to amend existing one. What is required is a new Constitution to meet the agitation and aspiration of all Nigerians and to allay all fears.

“The Executive and the Legislature need to work together to establish a Constituent Assembly. The exercise must not be compromised like the present Constitution; it must have full legitimacy of ‘we the people’. Talking of a new Constitution, maybe we should try a hybrid Constitution of President and Prime Minister sharing executive power in a Presidential cum Parliamentary system. And before we descend any further, let me warn, from experience, those who are beating the drums of war and domination from all quarters. I ed late Bisalla, under General Hassan Katsina, to write the appreciation and the operational instruction for the Civil War.

“We estimated that Federal Government would suppress the Biafran rebellion within three months. To make allowances for the unforeseen, we allowed six months. But it took us thirty months, five times what we allowed for, and what is more, we nearly lost the war. And as a Field Commander at the end of the war, I can attest that we fought with all Nigerian tribes including Igbos against Biafra.

“And if after over ten years of fighting Boko Haram, the terrorist group is still waxing strong, let nobody out of self-delusion think that a war of self-determination by one or more geopolitical zones of Nigeria with the present disenchantment would be easily suppressed by the rest of what may remain of the country. Some will fight to the last drop of the blood of their group rather than suffer the indignity of slavery, oppression, domination and atrocious injustice in the land of their birth and the only one that they can call their country.

“If Boko Haram can get an outside , any geo-political zone opting for self-determination may equally get an external . War may not necessarily go as planned, estimated and predicted. Everything must, therefore, be put in place to avoid a war, the end of which no one can precisely predict. There is no assurance that Nigeria can survive a second civil war. But rather, we should seek political solution and avoid a destructive civil war.

The Inspector General of Police (IGP) Abubakar Adamu, on Tuesday, ordered the closure of all Special Anti-Robbery Squad (SARS) satellite offices.

The directive followed Monday’s protests in Sagamu against SARS.

The people had marched against the killing of Remo Stars Football Club player, Tiamiyu Kazeem aka Kaka, in Ogun State.

Adamu announced the scrap when he accompanied Governor Dapo Abiodun, on a condolence visit to the home of the deceased Vice-Captain of Remo Stars.

The IGP was represented by Deputy Inspector General of Police, in-charge of Research and Planning, Peter Ogunyanwo.

He ordered that all activities at the satellite offices should be handed over to Commissioners of Police in the state.

Adamu assured that everyone responsible for his death would be prosecuted accordingly.

Abiodun and the delegation also visited the Akarigbo of Remoland, Oba Babatunde Ajayi.

The Governor said: “Today, I was on a condolence visit to the residence of Tiamiyu Kazeem’s parents.

“Tiamiyu, who was until his death, a vice captain of the Remo Stars Football Club died in an unfortunate encounter with some men of the Special Anti-Robbery Squad (SARS) who were on an illegal mission.

“Kaka’s death is irreversibly regrettable because Ogun State has lost a man of unexplored talents.

“But this long-awaited, significant reform within the structures of the Nigerian Police assures us of an end to such anomalies,” the governor added.

The Arewa Youth Consultative Forum, AYCF, President-General, Yerima Shettima on Tuesday insisted that Nasir El-Rufai, Governor of Kaduna State was working towards becoming the Vice President in 2023.

Shettima, who spoke exclusively with DAILY POST, made the remark while condemning the governor for saying the Southern part of Nigeria should be allowed to produce the country’s next president.

El-Rufai had said the North had no justification to hold onto power at the end of President Muhammadu Buhari’s second tenure in 2023.

The governor had stressed that the South should be allowed to produce the country’s next president in the interest of justice, equity and fairness.

However, Shettima stressed that the governor was only pursuing his selfish interest.

He maintained that El-Eufai’s comment was not in the interest of the North.

According to Shettima: “El-Rufai is just a governor and a mere politician who is ever ready to bargain for what he feels will represent his individual and personal interest.

“He is probably saying this because he wants them to consider him for Vice President and only God knows the side of the South he was referring to as he did not specify. But he may be saying this because he wants to be considered as a running mate to whoever will contest.”

The AYCF President General stressed that El-Rufai’s statement was not a reflection of the North.

He cautioned Nigerians against absorbing declarations of politicians without proper scrutiny.

Shettima added: “For us Northerners he remains a governor, his decision does not in any way reflect the interest of the North even in Kaduna he won’t get one-third. His statement holds no water and it represents his personal interest.

“You know due to his character of desperation, he is ever ready to bargain and that is why if a politician comes out to make any statement look at it thoroughly you will realise that it’s his personal interest.”

He expressed the belief that the governor was going about justling for the position of the Vice President because he’s not popular in the North, even in Kaduna.

“He is probably going around behind the scenes now negotiating to be Vice President of the country considering the fact that he may not be the popular candidate from the North. If the North is to produce candidates for the presidency, El-Rufai is not among the first 10 we are considering. He has probably realized that his chances are slim and narrow so he is ever ready to negotiate and make it looks like he is more accepted in one part of the country so he is willing to go around side by side whoever emerges from the South.

“I can see his body language that whoever he thinks it’s going to work with is completely doomed so whoever he thinks will consider him to be Vice President is just wasting time and whatever he says does not represent the interest of Northerners and it can never be.

“What do you expect from a sinking boat who has lost the goodwill of his people can’t go for third term as governor, as a result, he is desperate to remain in political office, hence he is ever willing and ready to bargain against the collective interest of his people because he’s desperate to hold the political office of the vice president and unfortunately for him he is not that popular so whoever considers him as Vice President should know his picking a product that is not sellable in the North. El-Rufai is a sinking ship that can only fall anywhere just to survive.”

The Leader of the Indigenous People of Biafra IPOB, Nnamdi Kanu was absent from the Burial Ceremony of his parents HRH Eze Israel Kanu and his wife, Ugoeze Sally Kanu.

Kanu’s parent, HRH Eze Israel Kanu and his wife, Ugoeze Sally Kanu who died last year, were committed to mother earth on Friday in their royal compound, Afaraukwu community in Abia State.

The IPOB leader was last seen in Nigeria on September 10, 2017 after some soldiers invaded his residence in Afaraukwu community in Abia State.

It is believed in certain quarters that the traditional ruler and his wife died due to the situation surrounding their son and the Nigerian government.

Meanwhile, the spokesman of IPOB, Comrade Emma Powerful said that Nnamdi Kanu was persuaded not to come.

“Our leader is much engaged with diplomatic moves for Biafra restoration, we begged him not to come home, let those at home bury his parents. He listened to his people, that is why he changed his mind,” he said when our correspondent asked why Kanu was absent.

In 2018, Kanu, however, resurfaced in Israel, where he was seen donning a Jewish outfit used for prayers.

Following his insistence for the actualisation of the sovereign state of Biafra, the Department of State Services, DSS, had arrested Kanu and arraigned him before a Nigerian court.

The IPOB leader was arraigned alongside three others, Chidiebere Onwudiwe, Benjamin Madubugwu and David Nwawuisi for charges bordering on terrorism and treasonable felony.

Following a public outcry over what many alleged tribal intimidation, Justice Binta Nyako of an Abuja Federal High Court granted him bail after which he eloped from Nigeria.

AUTHENTIC recalls that the Nyako-led court, however, revoked Kanu’s bail in 2019 and ordered his immediate arrest for jumping bail.
