On Tuesday, the of the Enugu State House of Assembly read for the first time a Bill for a Law to amend the Landlord and Tenant Law of Enugu State, 2004.

The bill sponsored by Hon. Okey Mbah, among other things, seek reduce the outrageous amount charged those seeking apartments by agents in the State by pegging the fee at 10% of the annual rent.

“With effect from the commencement of this law and notwithstanding any provision in other enactments, agent fee chargeable for procuring any accommodation in the State shall not exceed 10% of rent paid by the prospective tenant.”

Hon. Mbah also proposes that “no tenant shall be caused to pay any further in acquiring any accommodation except legal fee payable to a qualified legal practitioner for the purpose of preparing the landlord and tenant agreement and such fee shall not exceed 10% of the rent.

The bill also seek to empower Enugu State Housing Development Corporation through its managing director to any person who intends to operate as an agent in the State and give such person a permit will shall be renewed annually.

The bill futher proposes that “any person or persons who contravene any of the provisions of this law is liable, on summary conviction to a fine of N500,000 or imprisonment for a term of six months or to both such fine and imprisonment.”

Is it that prospective tenants can't rent a house without involving agents? Why not meet the landlord directly?

They should just abolish all these nonsense agent and commission fees.
They have even introduced caution fee, lawyer fee too.
That one no dey for registration of 10k too for the agent to help you look for a better house o.

Most painful aspect of them all Is, immediately agent find one yeye house for you and is not upto your Test, he will start dulging from your calls.

Also needed is some regulation of the ridiculous prices of properties for sale.

The law would have ed for a great one of not for the aspect of registration with government as an agent.
What do they want to regulate there again there are certified professional body for the big boys while the man must survive own is still there. Before you know it big registration money will enter and who eventually pay it? The would be tenants.
Government should pity the masses in this their wealth amassing for themselves Biko.

For us with below market rent, it will just end up in rent and instead of a one off payment they will end up paying it in perpetuity.

No wahala. Most problem get solution.
