Man102: I heard somewhere that the respective SG went into agreement with the FG to give them a 3 month window of grace and I think that window from the time the judgment was elapses October or November ending then all LG allocations will go into the LG s. But if for any other reason other than that except they want to say that the amendment of the constitution has to come first concerning the full autonomy of LGC then it's a welcome idea. Nevertheless it's about time the judiciary starts revisiting certain judicial judgment and make turnarounds. |

But sincerely speaking, what is tge noise about LGA autonomy. From the breakdown of the allocation, LGAs will be getting N329bn, we have 774 LGAs, averagely, each will get N435m. Can this even pay there salary especially their numerous ghost workers. The good thing i see about it is tgat it will solve ghost wotkers issue as the LGA chaitman will be in charge and know everyone to their home and can easily walk into any office at anytime. They will definitely drop many workers that are always idle doing nothing, reporting only once or twice a week, gossiping about every trending news. They will still want to do one or two projects, so they will have to cut down on unnecessary expenses. I even feel this is one of the issue OTTI of Abia state is having with them. Having numerous people on the payroll with nothing to show for it. Come for capturing and verification, they won't come. Just idling away at the LGA Secretariat. Infact I feel this LGA autonomy will allow State Government to work more as tge burden of paying the LGA workers will leave them and they will concentrate on various state ministries only which will be manageable. I think this is the reason why many of them are approving the 70k minimum wage now. Rural Local Government Areas have remained the bushes without government presence since the state governors started to ambush the allocations of the Local Government Counccils. State governors build showmanship projects like flyovers, International Conference centres, etc in the state capital and steal the rest of the state and local govt allocations. In most of the states, you may think that the state capital is all there is for modern development in the state. |

If the Supreme Court judgement was declared July 2024 and the federal government gave a 3 month deadline for issues to be sorted before direct payment into local government . It follows that the 3 months as not elapsed as at September, when the FAAC Payment was made", Secondly, 3 months from July should end in October 2024. The report does not give any indication when the 3 months grace period was offered by the Federal government? The reporter missed out some crucial information. For example, the statement from the govrt could have been after July when the supreme Court judgement was made. Besides, not all states in the federation has completed or conducted local government election yet as directed by the Court.. Some states are due for elections in November 2024. People live in local areas and therefore development must start from grassroot. People who resides in local government areas know their needs and are better placed to decide and direct the needed development and infrastructure. It creates ability as the leaders are not detached from the people..A local government chairman that fails to fix a dilapilated school knows the day the roof collapses and causes a casualty, the local mob will be marching to his house to remonstrate. . I believe the autonomy of the local govts is key for ability, which drives development, competence, transparency and mitigates the tyranny of nepotism and Godfatherism. When you begin to pay tax legitimately you will ensure that an incompetent family member, religious or political associates does not occupy a position of influence and power that ruins your interest and affairs. If every Nigerian was able, corruption and incompetence will not be an abstract spirit that cannot be address. Corruption is created and practiced by people. Punish people for their corrupt practices and you mitigate corruption and lack of development. Development starts from the local level. Anything that improves governance and self automomy empowers and impacts the graasroor directly. Local government elections and financial autonomy would no doubt be a mess in the next/first 4 or 6 years.. However, it would eventually come true when it becomes competitive and out of the powers of the state Governors as local government aspirants will be able to lobby for votes on their sef credentials and personal integrity. Slowly and surely we will develop our infrastructure and local government chairman runs its budgets, finds creative ways to generate revenue either by tax or value creation and then uses the income to build local infrastructure such as roads, schools, hopital, farms, youth and sport centres and then specialised on a particular area of advantage. For example, a local government in Delta state seems able to attract females into athletics. I hope as a nation will grow from the local level up!!!! |

"If any other law is inconsistent with the provisions of this Constitution, this Constitution shall prevail, and that other law shall, to the extent of the inconsistency, be void". (S. 1: sub. S. 3 1999 Constitution) In the light of the above provisions of the constitution, I think the supreme Court erred in its judgement. LGA creation, composition, and istration is clearly spelt out in the constitution and if there should be any form of variation, the constitution should be a place to run to for such adjustment by the reason of amendment. As part of the functions of the Judiciary, which is where the supreme Court falls into, it is primarily stated that its major function shall be to interprete the constitution and not amend nor repeal any part of it thereof. The national assembly should be the principal body in charge with this duty of amendment. All that is expected of the supreme Court was to have recommended to the national assembly and not to outrightly repeal the constitution outrightly. (Sec. 1, Sub. S. 6), the entire Sec. 7 and the third schedule of the 1999 constitution which created the LGAs and it system of istration never gave the duty to alter its structure to any institution in Nigeria. The only way out of this is to amend that part of the constitution by the national assembly that gave room to a t between the state and the LGAs and the powers of control and funding vested on the states over LGAs. Even if the ruling is implemented it still amount to abuse of the Nigerian court process. 1 Like 1 Share |
