He wouldn't say that on tv

I watched it. He said worse than that.
He even talked about how there are sections in prisons for pregnant women and said he would rather die than give up the case.

Again a consumer has the right to review the product or services consumed! This is non debatable! There's something called cause and effect, a product does not need to directly cause harm for it to be harmful.

Exhibit one:
Vegans accuse meat eaters of eating carcinogenic items aka red meat.

We have over 100 scholarly and well researched studies that shows red meat is carcinogenic.

We have thousands of people that die each year due to cancer from bad diet.

Are you saying as a meat company, you would sue such a vegan?

Exhibit two:

Climate change is real

A climate activist claims that deisel factory is polluting the air causing climate chnage which can result in people dying.

If you're the owner of that factory, will you arrest the activist even tho there are empirical evidence that confirms air pollution is having a disastrous effect on climate.

In summary, the charges does not correlate with the offense, it is hogwash and nonsenstical and can only succeed in a dystopian country like Nigeria!

You can give bad review. Nobody is against that. There's fine-line between bad review and defamatory review. And as you should know by now, only the court can and will decide what is defamatory. Nobody else can.

Let the court decide. I'm not here to speculate, and I don't really care who wins either. What is important is either ways, companies and the consumer public will learn a thing or two from the whole saga.

Again read the charges, she was not charged with defamation but cyber bullying or whatever, that's ERROR #1!

Furthermore, we all know there's no way she'll get a fair trial, as she's a nobody and human rights activist lawyers are not that good.....The problem here is that absence of any law that protects the consumer in cases like this, the loser will 99% of the time be the CONSUMER!

Recall that the CEO of Erisco Foods, Eric Omeofia, had alleged in 2023 that a negative product review by a customer, Chioma Egodi, negatively impacted his business when she claimed that the Nagiko Tomato Mix she bought had too much sugar.

Okoli’s lawyer, Inibehe Effiong, told the court that his client suffered miscarriage in the course of the case and eventually lost her baby.

Okoli is standing bordering on conspiracy and cyberstalking leveled against her.

O pari.

This erisco tomato paste matter should not have escalated to this extent in my opinion. The extent it has gone now is not helpful for an amicable resolution at all.

This is a lesson to everyone to be careful about the advice people give to you, especially if it's a legal opinion.

If you post a comment or say something the other party consider as offensive to his or her brand ,if your comment is a well-intentioned advice but ,unfortunately, taken wrongly, please just delete the comment(s), apologize to the one who took your in a wrong way and move on with your life. If you're right, you will eventually be justified by posterity and one day the person who feels wronged today will credit you as the one who gave a truly sincere yet you apologized for peace to reign. You become the bigger and more matured party eventually.

I will encourage her husband, family and lawyer to help her out of the current predicament. Let all the parties please explore amicable resolution options if it's not too late yet. It's good that she's being given the opportunity to defend herself so that justice can prevail.

May God bless Nigeria for ever! Check my signature for free stuffs!
blame all these on that rabble ro called, inibehe effiong who keeps giving chioma, wrong advise

Your write up is biased
Seems you don't know what she did to erisco and the consequences.

What did she do? Is it civil or criminal?
If you influence a case because of your status/network , it's bullying. Should you follow the case as is determined by the legal framework then you might have a case.

Are there precedents to fake/false and/or negative reviews? Yes! Did they end up in incarcerations? Yes some do. But the procedures of prosecution makes this an extreme case of bullying with prejudice.

bros build a pure water company and let someone comment dat your water is killing people and see how your sales will decline

So if someone comment that your product kills, your next line of action will be to go all out to hound and destroy the person? You need to see how societies run.

Go legal, prove, win, and let the judge or jury determine the penalty. Once you first use your influence and wealth to harass, use the security agencies to hound, come on Television and judge when you're no judge or jury. The case has lost its merits and you're just like an average high school bully.

I'm not vouching for anyone, I'm voucing for the ACT! It is consumer's right to be able to critique items or services they paid for! You cannot silence people all because you don't like their review.

Some decades back, everyone taught smoking was cool and fashionable, now we know better thanks to research and people voicing out on the dangerous effects of smoking.......If we went by your analysis, we would have questioned their motive rather than look at the product itself!

But the truth is that most people nowadays are not sincere in their criticism.

It's on her part to prove it. Normally, 9ja matter dey always dey different. Presently, due to financial earnings from social media people just say anything they like.
Nobody business will take such lightly. Don't expect someone to react nicely.

I watched both interviews.... The owner said he'll take her to court that she must prove that his product is killing people.... The woman on d other hand was crying that she was denied freedom of speech in her country.... You guys are siding with d lady because she's poor or not as wealthy as d man.... Being poor doesn't give you d right to make unfounded claims.... Like I said earlier, she should have apologised when she had the opportunity

You know the shrink insisted you don't miss them and we are all very concerned about you.

Now I hope you reflect on the lectures you were provided with yesterday.

There is bad reviews and defamatory review. There is a difference between 'this paste has too much sugar' and 'this tomato paste is killing people' and insisting that it is true...where is the evidence that people died from using the paste?

You aren't being logical bro...Haba!!

This means u didn't read her post! Her post didn't say anything about it killing ppl! Even st that defamation cannot be applied to customer experience or product, it must av a person character!

You are the confused one, and if you studied law there is a real problem if you don't know the difference between the Nigerian Legal System and the law.

I expect that this will fly over your head as well.

Secondly I didn't say anything was unenforceable Please quote where I did. Wirinet said so and whatever you might think, he is not me. Scroll through our profiles.

You skipped Jurisprudence classes and prolly Law of Tort classes. And NLS (Nigerian Legal System).
Me I am not a lawyer, I studied architecture at the university, so the only law course I took was Land Law.
Having said that, I understand the general principle of law and law making, which is to build a peaceful and stable society, through equity, transparency and natural justice. The goal of the Penal Code does not include these. The Penal Code currently in use today is a law enacted in 30th September 1960 (a day before independence), an offshoot of the Penal Code of the colonial government. Its goal was to keep the general population under check and subservient to the central government. The Penal Code is so voluminous, it has 37 chapters and over 470 sections. Majority of the items of the Penal Code are ambigious, it is only be used to oppress the poor and helpless citizens.
Here is a link to the Penal Code (section 26 - 37) - https://lawsofnigeria.placng.org/view2.php?sn=432

Firstcitizen is probably not aware that the same Penal Code he is ing with his "law is law" in chapter 2 section 55 permits a husband, teacher, master to beat his wife/student/slave and children as long as his intention is not to kill them. There are so many other stupid laws like the criminalisation of juju and criticizing the person of the President or the Governor of a State.

You can the other sections of the Penal Code here - https://sabilaw.org/wp-content/s/2022/04/Penal-Code-Act-1960.pdf

Jurisprudence, lil bro, is more the province of the classroom and the legislature than the court room. To be sure, it is also relevant in the court room, but it has to be settled in these two places I have mentioned first.

You are not a deep thinker and the reason I called you lil bro is I can easily guess your age. It can't be beyond 20 - 25.
