Good day to you all, I'm on the verge of buying a house for a close family, I bare the responsibility of making payment and ing that the property is genuine because I'm the one that introduced him to the agent.

I'm trying to be careful because of some clauses that involves the originality of the seller. Mr. A built the house from the ground, lived in it for like seven months then relocated abroad, he appointed a representative ( I think his brother) to sell the property, Mr. B ( also from abroad ) ed a company to buy the property on his behalf, the property was inspected buy consultant C ( A company ), payment was made and the house was taken over by consultant C but Mr B never occupied the said house since Inception of the purchase, after 15 months of procurement Mr B decided to sell the property through same consultant C.

The neighbour can't ascertain the relationship between Mr A and consultant C , but Mr A has been informed by a neighbour about the presence of consultant C in the house and he confirmed that the house has been sold off . Consultant C do visit the house periodically but the house remains under lock.

The problem now is that consultant C want me to pay directly to him, refusing to give me Mr B. phone number for verification, sighting that the consent letter given to him by Mr B is enough proof. I suspect he's hiding the real price from the owner but I don't want to go ahead without ing the identity of Mr B ( the current seller). The intending buyer is so in love with the house and cant wait to make payment but I'm hellbent of hearing from Mr B

Duely signed and ed deed of assignments of the house should clearly spell out the real owner of the house. Because the Deed is the only documents that will show transfer of ownership of a property. Secondly you people can organise a conference call where all the party involved should speak out.

Buying a house shouldn't be of the complexities you have stated above. There are several decent properties you can buy with the owners physically present. Why do you want to get yourself involved with this? Drop the business deal like a hot potato!!

This one that you’re saying Mr A, Mr B, Consultant C and worth not. Can’t you buy a land and build a house without all these many issues. The consultant like you said is trying to make 50% profit off you. There are too many stories to this property. Be wise. Don’t let you have money but you in trouble. Unless you can bear to lose so much money if you’re scammed at the end. I prefer to build my house than buying a house. It’s a more wiser decision.

Thanks for your response, it's concerning that the consent letter consultant C showed me doesn't carry address or phone number of Mr B, maybe it was cropped out, I suppose. I suspect that consultant C might want to make a huge profit on the sale and trying very hard to hide it from Mr. B, the neighbour also told me that consultant C has been selling some properties in the house which I believe Mr B isn't aware of ( because the house is going with all the properties Mr A left behind such AC, TVs, etc, consultant C even told me that he will be removing the biggest standing AC after the sale) . He showed me the offer letter he made to Mr A on behalf of Mr B in 2022, there I realised he's selling with a 50% profit margin.

This is exactly how it starts. The would-be victim begins to make excuses for red flags starring them in the face. Those were not cropped out. Treat everything as deliberate.

The agent seems not to know his game.
Even if you get to meet the owner directly and you got a discount from him, you will still pay the agent sum and commission.
You have right to meet the seller or have his , it won't have any effect on the amount you already agreed on.

Advise your client to calm down as Mr C is not fully transparent, you don’t get attach emotionally to any property you don’t own yet regardless of the value/beauty

It’s a buyers market and you ought to be calling the shots not the sellers

Demand to see Mr B ID (international port and NIM) through your lawyer and accordingly

Anything other than Direct ownership, please run.... Except you are ready to spend heavily on court cases and you may loose it eventually.

My candid advise:

1. Don't get yourself involved in a mess in the name of property, because at the end you will regret ever getting involved in it.
2. The involvement of a lawyer in a transaction does not guarantee that the deal would be successful. This lawyers are not gods. When trouble surfaces later, the same lawyers will tell you to bring millions to file a case in court over that property, and the case may take years before court will decide.
3. Don't be too much in a hurry to buy a property, you may loose your money too quickly.
4. More importantly, when you are suspicious of a property, simply walk away. There are many other better properties elsewhere. All you need to do is exercise patience and search diligently.

I'm a Lagos which is the most risky place to buy land on earth so listen....

There are several documents you need to see and before paying for that house but the 2 most important of them all is..

1. Certificate of occupancy
2. Power of attorney

Have a lawyer both before paying a dime or you won't see your money again.

Buying a house is a big spending.
As a rule,
1. Do not rush into things like this.
2. Do not let emotions lead... Buyer should calm
down
3. Follow all due processes even if it will come at some cost. It's safe and better than being scammed...
4. Always involve the professionals (lawyers, estate surveyor and valuers etc.)..
5. Never be lazy to thoroughly read all contract letters, agreements including the little fine prints...

There is unclear path to the ownership of the house.

Consent is not enough to sell the house. Who has the power of Attorney to sell the house? Is the Power of Attorney ed with the Lands Ministry?.

Don't be quick to lose your money for this Tinubu period.

As someone who has lost millions to real estate in lagos in the past, trust me, this has all the hallmark of fraud.. Get a good property lawyer or I recommend (Omonile lawyer, Google them).. I have no connection or interest in the aforementioned law firm or neither am paid to them, am just a over satisfied satisfied client, who they save from throwing more money away. Thier fees is abit on the high side, but dem go investigate that property for u very well, if the property is in lagos. And u can take that law firm verdict on the property to the bank any time..
