My mum's tenant haven't paid their rent for 8months as at September dis year. My mum gave Dem a quit notice to vacant her house before Sept. 20th or leave her house. Meanwhile d tenant lost her father and were planning to go for burial. They didn't pay and packed their things inside the one room apartment, locked it and travelled for d burial. They(the tenant and her jobless husband) weren't even calling mum at all ooo.
Now Mumsy came back and thought they had travelled a d opened the lock to check if they had packed their things only to discover they didn't pack not pay anything and left

Now they told me, cos I was around dat time, that they would be coming back immediately after the burial(the burial was Oct 14th and they travelled Sept 26th). They didn't come wen dey said dey would nor did they even call. I was d one calling and asking to come back and pack if they don't want to pay. She was telling me I'm coming today ir tomorrow till after two months. To cut d story short., she came back and went to the police dat we broke their key without even confronting us first to ask why. This is someone we are begging to pack their things after 11months without asking them pay cos dey don't like paying rent and dey cant even pay too. This is someone I buy things for her and her kids knowing their financial incapacitation cos the hubby is learning a hand work now when dey have 3kids at hand

this is why you shouldn't take laws into your hand.

Your mum shouldn't have broken into their apartment without the presence of the law enforcement agents.
Now they have a case against your mum.
My advise is, your mum should call them to resolve the issue amicably without involving the Police.

Try and get them through phone, also your lawyer on what next to do cos if you break your way into the apartment you will end up paying the tenant.

Just drag them to mediation center. The issue will be resolve amicably. But bear it in mind that they would enjoy additional time grace.

NB:- As a word of advice. Persuade ur mumsy to give the house to an estate agent to manage. She doesn't need to bother herself over something that is very easy for the professionals to handle without any hassle

The problem now is that Lagos State Tenancy law frowns at self help. Your mum should have initially ed a Lawyer who will safely show the tenants the way out.

There is no need for you to wonder any more.Banging is the only thing that gives the poor solace in the midst of hardship. Poster please engage the service of a seasoned lawyer. Next time no matter the level of provocation from tenants don't take laws into your hands. It is your house though but for the time being they are the legal occupants even though they are yet to pay rent for a long time or has the tenancy agreement been destroyed?

Landlords n tenant relationship are tom n jerry.......abeg make una free those tenants jor after all we are all temporary residents in this world.

Your mum has no right to break into the room, they have a case, very serious case against your mum. Whatever they claim is in the room be it money etc your mum will be made to pay it back.

The proper thing to do is to give them quit notice six months earlier through your lawyer and follow the proper procedure.

Just prayer because if you treat d tenant d way he/she doesn't like, if he/she takes you to court they might stay in ur house for more than four yrs without payment. Landlord n tenant walaha is a very serious one, u HV to handle it wit care.

This people don't want to pay. Even before d demise of her dey find it difficult to pay. Mum even went in the past to give dm advice on doing ajo daily in order to pay but dey didn't keep up. Imagine a woman dat the husband does nothing but stay home and impregnate d wife. The truth is them not wanting to do anything to pay their is wicked. I personal know how much I spent on dis family to help Dem especially feeding and medicals.

If I may advice. and conditions are very strong. So next tenant write a and conditions that if he doesn't pay after --- month he's belongings will be forcedly thrown. When he agrees you have no problem..

Biggest mistake ever. The court will first grant them 6months of extra stay. And adjourn the case till 2019. By them your tenant would have stayed extra 3years without payment.
If this your tenant is in Lagos, I heard there's a new alternative to suing to court.
