Adekunle Sobaloju (SAN), counsel for Mr. Hamzat Oriyomi, has argued that the Oyo State Government has no legal justification to detain his client and other defendants arrested over a deadly stampede that occurred at a children's funfair in Ibadan.

Mr Hamzat was arrested along with Ooni of Ife's ex-wife, Naomi Silekunola and Islamic School Principal, Abdullahi Fasasi, over the stampede that occurred at Islamic High School, Bashorun.

At least 35 children were confirmed dead during the tragedy.

Mr. Hamzat and his co-defendants submitted bail applications to the Oyo State High Court on Tuesday. However, after considering arguments from both the prosecution and the defence, the court adjourned the case until January 13, 2025, effectively delaying a decision on their bail requests.

The prosecution was led by the Attorney General of Oyo State, Biodun Aikomo.

Addressing journalists immediately after court proceedings on Tuesday, in a video obtained by SaharaReporters, Sobaloju said his client, Oriyomi had convincingly pleaded before the court to grant his bail pending proper arraignment.

He said his team also argued strongly before the court that the government has no legal backing to detain his client and others arrested over the deadly stampede.

He said: "Well, what we did was we filed an application that he should be itted into bail pending arraignment, and the application was argued today. The court listened to all the various arguments, and the ruling was reserved till the 13th of January. So principally we are saying that he ought to be itted on bail based on certain grounds which I would not want to expatiate on here.

"We are saying by law, they (the defendants) ought not to be arraigned by holding charge. That ordinarily, they should have followed the provision of the law, which is section 292 of the istration of Criminal Justice Act (ACJA), which says that they should not be detained or remanded in custody based on the holding charge.

“We have canvassed the points in court and it is for the court to deliver a considered ruling on it. It is for the court to decide (if their continued detention is legal or illegal). But for us, holding charge is unknown to the law."

The court, on Tuesday, reserved its ruling on the bail applications filed by Naomi, Oriyomi and Fasasi.

Were the ones that kill the kids? Does your government have an emergency response plan or anything close to that? Your government inflicted hunger on the nation, driving people to the brink of desperation. Some good Samaritans came to offer succor...and shit happened because the people were hopelessly desperate. What's the responsibility of the parents that threw caution to the wind and exposed their kids to unwarranted danger? I heard that some even threw their kids across the fence.

What the government is to do, is to set up a committee of a kind to investigate what happened and how to forestall future occurrence. Not making an escape goat out of some few people.

Aside from the stampede which many know that such is bound to occur, events after makes me cringe and at the same time laugh too, maybe it's a bittersweet experience from my own POV.

And again, the Nigeria legal system is more of auto-pilot now, anything goes more reason, I'm sceptical about the whole court process.

Meanwhile, A nigga over here wanted schooling me on the so called charges when I ed a copy of the court extracts last month, I guess my reply to him was a bit condescending reason he didn't stoop so low to educated a lay man like me on the Ts and Cs of the law. Senior man, if na you be the person, I still plaster on top the matter o abeg enlighten me.

What exactly is their offense.Are they the one that asked greedy parents to caused the stampede during the event. Besides, police was aware about the event, why didn't they provide enough security. Finally what is the government of seyi makinde doing to alleviate the suffering of his people. Is it a crime to help people since government could not do it. Besides APC spoke person said that nothing new in the stampede because it occurs normally in advance world too. Even senate president said wherever people see food they should eat it.

Everybody was managing their hunger in their various homes until the organisers invited them to their deaths.

Lawyer don't complicate dis matter by going to the press, everybody dey vex right now ..... It's a case of negligence so I think it's a non-Capital offense and they should be granted bail..... E Don Tey wey we don dey suffer for dis country, no be 2014 wey immigration wan do recruitment, over 26 people died, and nobody went to jail....

If dis kind thing happen abroad, even d governor go resign....

Everyone keeps talking about Justice for Hamzat and the former Queen here and there, forgetting that 35 children are involved here, you don't just sweep things regarding to children under the carpet, whether or not in was intended or not or whether or not the signs were there prior to the event or not the fact still remains that children lost their lives and those who are behind the event must be held able and adopting all judicial avenue to ensure justice is done but be adhered to irrespective of who is involved.

What are they going to be charged with? Criminal negligence? Reckless endangerment leading to death? Those offenses should be bailable as long as it's not first degree murder. I honestly don't see why they're still being held in prison at this point.

When are they going to arrest the unruly parents that caused this mess. Some of them threw their children over the fence leading to death of one and injuries on several of them. Why is no one holding them able for this tragedy? The sensible thing to do when you get to a crowded place with your your young child(ren) is do whatever it takes to keep your child safe and away any form of harm. The parents defied all forms of decorum.amd common sense putting their children in grave danger yet they're taken as victims. If only a handful of the unruly parents were arrested alongside Queen Naomi, Hamzat and the principal maybe I would have made sense of their continuous incarceration
