The Rivers State Government has clarified that the recent Court of Appeal judgment in Abuja did not reinstate the Martin Amaewhule-led faction of the State House of Assembly, dismissing claims that they remain of the Assembly.


In a statement issued on Thursday by the State Attorney General and Commissioner for Justice, Israel Dagogo Iboroma, SAN, the government insisted that Amaewhule and 26 other lawmakers had automatically vacated their seats upon their defection from the Peoples Democratic Party (PDP) to the All Progressives Congress (APC) on December 11, 2023. According to Iboroma, this defection triggered Section 109(1)(g) of the 1999 Constitution, which mandates that lawmakers who switch political parties lose their seats.

“The issue of defection of Martin Amaewhule and 26 others was never before the Federal High Court or the Court of Appeal. Therefore, no court has legitimized their hip of the House of Assembly following their defection,” Iboroma emphasized.

The Attorney General further explained that the case at the Federal High Court and the subsequent appeal concerned the 2023 Appropriation Law and the National Assembly’s intervention in Rivers State’s legislative functions, not the status of the defected lawmakers.

Following the dismissal of the state’s appeal regarding the 2023 Appropriation Law by the Court of Appeal, Iboroma criticized the misrepresentation of the ruling. “There is a wave of false reports suggesting that Amaewhule and the others remain in the Assembly with him as Speaker. This is patently untrue,” he stated.

The Attorney General also announced that the state government would appeal the ruling to the Supreme Court and file an application for a stay of execution to maintain the current status quo.

Governor Siminalayi Fubara, according to Iboroma, has urged the people of Rivers State to disregard any misleading reports regarding the court’s judgment and assured them that legal steps are being taken to resolve the matter.

Ofcourse the judgement of the court of appeal yesterday was about the budget. The status of the defected lawmakers was not a subject of determination. Nullification of the budget was based on the fact that Fubara withdrew his case earlier at the federal high court as a result of the peace agreement and cannot appeal it. But the judgement itself is an academic exercise since the 2024 fiscal year would have ended by the time supreme court concludes it.

This case will continue until 2027. There are other several similar cases in various courts. All what I know is that it will take more than judicial pronouncement to bring back these lawmakers to the house.

In the interim, the governor is preparing the 2025 budget

If the issue is on the age of 2024 budget, by the time Supreme courts rules, 2024 would have been over. The judgement might end up having zero effect on the issue of 2024 budget

By the time the Supreme Court rules on the matter, 2024 must have gone. By then it will become an academic exercise. 
 
And as for the former lawmakers, having defected from the PDP to the APC, they automatically lost their seats, and those seats remain vacant until INEC conducts a by-election; unfortunately for them, the party they claimed to have defected to said that they are not their . Too bad for them because they allowed Wike to deceive them.

Their political career ended abruptly.

In all of this communiqué, the most important legal thing Governor Fubara has done is to

1. Apply for stay of execution of Appeal Court Judgement

2. Appeal the judgement at the Supreme court.

That's is law..that is legal.

Every other thing written in the communiqué na mere political statements.

The question will be, what happens if the stay of execution is not granted

What happens, if he finally lose at the Supreme Court

Which is better...representing the budget as directed by the Court of Appeal, while challenging the decision at the Supreme Court.,.if he wins..fine ..if he lose...fine...he will not have huge problems with the House of Assembly should he lose.

..but, if he doesn't represent the budget and he lose at the Supreme Court....will that not be a solid legal ground for impeachment
