Court s Traditional Council in Suit against Oba of Benin

*Edo govt says no hand in raging dispute

The Edo State High Court in Benin City, has itted the Benin Traditional Council (BTC) as a party in a suit instituted by suspended Enigies (dukes) against the Omo N’ Oba N’ Edo, Uku Akpolokpolo, Ewuare II, the Oba of Benin.

Two suspended Enigies of Evbuobanosa and Egbaen Siluko dukedoms in Benin Kingdom, Prof. Gregory Akenzua and Chief Edomwonyi Ogiegbaen had on behalf of others, sued the Oba of Benin at the Edo State High court, challenging their suspension from office.

Besides, the duo on behalf of others, had claimed that it was only the State Governor, Mr. Godwin Obaseki and not the monarch who can pronounce them suspended or remove them from their positions.

Ruling in a motion on Thursday May 9, 2024, Justice Peter Akhihiero granted the 1st defendant its plea to include the Benin Traditional Council as the 3rd defendant in the suit marked B/250os/2023, while Oba Ewuare II and Edo State Government, were the 1st and 2nd defendants respectively.

The ruling was in response to an application filed by the 2nd defendant’s lead counsel, Prof. Yemi Akinseye-George (SAN), Prof. Edoba Omoregie and his team against the claimants.

Justice Akhihiero directed parties in the suit, Edo State Government represented by the State Attorney General and Commissioner for Justice, Oluwole Iyamu (SAN), Oba Ewuare II, Akenzua and Ogiegbaen, who were both represented by their counsel led by Dr. Osagie Obayuwana who had objected to the motion through the Counsel of Oba Ewuare II, to amend their relevant documents in the case to reflect the decision.

While other parties in the suit aligned with the position of Oba Ewuare’s counsel to Benin Traditional Council in the suit, the claimants Akenzua and Ogiegbaen through their counsel, Obayuwana prayed the court not to list the traditional council as a party in the suit.
He urged the court to award cost against Oba of Benin in favour of the claimants.

The judge, however, turned down the prayers, and held that Obayuwana should not worry about the timing, insisting that: “The race is not for the swift, or the battle for the strong”.

“If they were bringing in the traditional council as necessary, I don’t see this as a problem since you people have brought the Oba to court.
“I don’t think I can shut down any party. Let them come in and file their processes”, Justice Akhihiero said, before adjourning hearing in the case to July 15, 2024 in the absence of any objection.

Meanwhile, the Edo state government yesterday said it was not involved in the suit involving the Oba of Benin and Enigies in the state.
The government also noted that it was only a defendant in the suit like the Oba of Benin, Ewuare II and as such has no interest in the matter as being insinuated in some quarters.

The state Commissioner for Information and Orientation, Mr. Chris Nehikhare, who stated this in a press briefing in Benin City, on behalf of the government, called for out-of-court settlement.

However, Nehikhare said that government was concerned that such a matter among brothers could be allowed to degenerate to the extent that it has become a court case.

According to him: “The Edo state government has appealed to the parties involved to reach a peaceful settling out of court”.

Nehikhare also promised that government would like to be part of resolution of the ongoing dispute, so as to bring the matter to an amicable resolution.

By tradition the Oba of Benin is the chairman of the Benin Traditional Council. However, two Enigies allegedly wrote to the Edo State Government that it should create another Benin Traditional Council.

The people of the areas that the Enigies oversee wrote to the Oba of Benin to complain about the behaviour of the Enigie. The Oba of Benin summoned the Enigies to his palace to find out what the problem was. The Enigies did not go to the palace, so the Oba of Benin suspended them.

The Enigies then sued the Oba of Benin and the Edo State Government. They say that the Oba has no power to suspend them and only the government can suspend them.

On Wednesday night, Obidients began circulating a rumour that the Edo State Government had sued the Oba and summoned him to court. This forced the Edo State Government to release a statement on Thursday that it has no lawsuit against the Oba and in fact, it is a defendant in the case.

Benin again..

Why is benin(kingdom) the most uncertain tribe in the country today; with no substantial evidence of where they came from and who there predecessors or descendants are.

Today, ask the benin people who there descendants are:

(The 1st day) They will claim their descendants are the yorubas.

(Day 2) They will say it's the Ijaws

(Day 3) They will say it's the Igbos

(Day 4) They will say it's the Ikwerres

(Day 5) They will tell you is the Isokos

(Day 6) They will say its the urhobos (after the migration) - Everytime they will tell you that is either they migrated to that place or that they conquered through war.. People with barely 4 local govt in Edo state, is it not funny?..

Presently, they're raising unequivocal issues and doubts among other confused tribe that are willing to dive into their confusion.

Benin people are really confused who they are, where they came from and who were their good or bad neighbours.

Today they claim fathering Yoruba, tomorrow Igalla or Ijaw, next Igbo, Ikwerre or Opobo or Urhobos. They seem to be hopeless in determining who they are.

(And they claimed they once had a kingdom, hmmm).

How can you be a father to communities that are one hundred percent more than you in population, with highly sophisticated different languages, culture, tradition and customs? See the sizes of Yoruba - Benin, Igbo - Benin, Igalla - Benin. It is that of a Squirrel to an Elephant, and you want a sage to believe that the squirrel is the father and founder of the Elephant. So where is the rationale, the similarity, the closeness, etc.

Their various concocted historical tales are like many herbs in a cauldron giving vane remedy to any sickness, such a tragedy.

I'm a proud Igbo from Obio akpor.

Our fathers never told us we were from bini nor hausa nor yoruba, na their business sha.. All their jokes is on them grin

Politicians have brought our once-revered traditional institutions into brazen disrepute.
Imagine hearing that the King of England is appearing before a judge over a case! Abomination! Aru!

Traditional cases involving high-profile kings shouldn't be handled in civil courts. The governor ought to get involved and prevail on the Oba to tender justice with mercy without things escalating to this point.

Obaseki had better beware. The state govt may not be behind this as he has said. However, if the Binis ever get the impression that he somehow has a hand in this, then he automatically has a huge problem getting his candidate installed as the next governor.

It will pay him to get this matter resolved amicably out of court before it festers beyond control.

Thr mandate thief has brought divide & rule to destabilize Edo state & Benin Kingdom.

The suspended Obas quickly rushed to court because the voice of Jacob & the hand of Esau have assured them to take the matter to court where balablu have appointed his stooges to always give him court victory through the miscarriage of justice.

Know this balablue, the way you brought division into the Christian fold, buying fake bishops, fake afenifere will not work in edo state.

Edo no be Lagos for real

I wish the court to DIRECT the Oba to rescind Illegal order, so that, the army of his illiterates and educated-illiterate followers would know that, Oba of Bini is mere a mortal and that he is subjected to constitution of the land, contrary to their belief that he is small gods on earth.

....FOR JUDGES TO DIRECT HIM TO COME IN PERSON TO THE COURT ON THE DAY OF JUDGEMENT.......................

Back to the colonial era when the traditional institution was placed under the dictates of her Royal Majesty. By mere pronouncement, a judge can decide the fate of Benin Kingdom. When Oba of Benin started frolicking with politicians, we knew that it is a matter of time before they water down his influence. Sanusi still couldn't fathom out what hit him as the Emir of Kano.
