Hi I have a friend of mine who stays in Lagos, he has a problem and has been unable to pay his rent for almost a year, the rent has expired since July and now his landlord is telling him to pay by next week or pack out of the house. He's arguing that the landlord is mandated by law to serve him a 6 months quit notice before he can leave but I'm telling him to find his way out of there as soon as he can since his rent has expired.
Is he right with what he's saying or should he instead take my advice ?

Unfortunately, they don't know that in most cases you start with a security deposit (usually one month's rent), which means you are paying 2 months rent in your first month of stay. Then, your subsequent rent is due on the 1st of the month with a grace period of 3 days. Once you don't pay after 4th, you start incurring penalties. If you don't pay by the 15th, you are already looking at eviction. Meanwhile, by the time the landlord sends you out at the end of the month, they are not really out of pocket because they technically have the month's rent.

in the event their rent is still Running, asking them to leave on n3, which implies 6 months, means he must refund their rent from date of the quit notice to the duration give

The 6 months' notice actually covers his rent period which is only accepted by people that doesn't know their rights, the notice should start from the expiration of his rent and not in between his rent.

Why not give him an extra 3 months' notice, the 3 months' notice will start counting from the day his rent expires.

You want to mislead this guy in the hopes of extracting a few pennies from him. Oncd a quit notice is validly served, there is no such additional 3 months.

yes he is right, the landlord should have served him a 6 months notice whether he is owing or not. But there is a different side to this, if the tenant has no legal written contract then the tenant has no ground to stand, The tenant can only demand for 6 months notice if he has a written agreement that's states so!

I have read that particular section of the law a few times. I am only trying to be fair. The most important thing is that I can confidently pray that I would always meet "my type of tenant" if I am on the other side of the table. Do you pray the same for yourself or you want those that will use all their sense to ensure you do not enjoy the rewards of your labor?

Never. There is nothing like staying in someone's property for free in the name of notice. The law is very clear on this issue.

We are very close there cos as it is, man on the street cannot pay N2million for a 2bed flat easy.so the average city rent in Nigeria is N120k per month so you need to earn at least n300k plus.

what state is this? In lagos a lawyer will issue the quit notice and after the 6 month if the tenant refused to vacate then you will issue a 7 days notice and after that you will go to court. All these are precedent you must follow before going to court


Must it be issued by a Lawyer? Can't the landlord issue the quit notice and the seven days notice himself?

Whatever you mean by being 'into the legal system' is not equivalent to being a lawyer. The Notice in this instance is clearly in accordance with the Tenancy Law. If you pay your rent yearly, you are entitled to 6 month's notice to quit.
Where the term expires and your rent is in arrears, you will receive only the 7-days Notice.
That the court system could be manipulated to prolong your stay in a house is a dying culture in Lagos now. Pray you don't tempt a wicked landlord with this jungle plan as you may find yourself on the streets without knowing why.....

The chap you are responding to is a proper Olodo.

The tenancy law states that for a yearly tenant, he must be given 6 clear months in advance, which need not terminate on the annivasery date but can terminate after the anniversary date. The only but is that he must be allowed to use what he has paid for. but on the very last day the notice takes effect and he has used what he paid for, but refuses to vacate, he would be served 7 days notice.

Only ignorant people think they are entitled to any extra days

He should quietly pack out as the landlord is not demanding for the arrears he is owing.

If the case eventually goes to court and the lawyer demands he pays everything he is owing, he will pay to the last kobo and also pay additional amount for cost of action.

Unless the law just changed, any quit notice starts reading when your rent expires. You can't put tenants under pressure when their rent is still reading.
The law has not change. It is because you don't understand the law.
