Tribunal Sacks Lagos LP Rep Sowunmi, Declares APC’s Ogunyemi Winner

The tribunal agreed with the petitioner that the candidate of the Labour Party was not qualified to contest the elections.

The National Assembly Elections Petition Tribunal sitting in Lagos has nullified the return of the Labour Party (LP) ’s candidate, Seyi Sowunmi as the House of Representatives member for Ojo Federal Constituency in Lagos State.

Instead, the three-man led by Justice Abdullahi Ozegya declared the candidate of the All Progressives Congress (APC), Lanre Ogunyemi, as the duly elected candidate of the election conducted on February 25, 2023.

The other of the are Justice Ashu Ewah and Justice Muhammad Sambo.

Ogunyemi, a two-term state lawmaker and former secretary of the APC in Lagos, had challenged the declaration of Sowunmi by the Independent National Electoral Commission (INEC) as the winner of the election on the grounds that the respondent was not duly sponsored and qualified to contest the elections under the candidacy of Labour Party for Ojo Federal Constituency.

In its judgment on the petition, the tribunal agreed with the petitioner that the candidate of the Labour Party was not qualified to contest the elections.

It, therefore, declared his votes wasted and held that the second runner up, APC’s Ogunyemi, ought to have been declared winner of Ojo Federal Constituency.

No doubt. Like the nearby Amuwo Odofin, Ojo was an LP stronghold in Lagos. But then, they're saying he was not qualified to contest.

If he could prove that he was, he clearly won.

Besides, if it's about his candidacy, is the tribunal not subject to the Supreme Court? There is an existing judgement (stare decisis in this case) that validates whomever a party decides to allow participate in the primaries (no locus standi for other parties to contest such). Here is what the supreme court said to this effect:

That someone’s name is not on the party is not grounds for disqualification.

Akanudofia who was the APC governorship candidate in the last election in Akwa Ibom was a member of the PDP until the night of the APC primaries when he defected and won the APC primaries.

At what time did his name appear in APC ? But yet the Supreme Court validated his candidacy.

So, all these kangaroo judgments will never stand.

Majority people that question the judgements of the Nigerian courts, especially at Appeal and Supreme courts, don't even read the judgements to understand the rationale behind those judgements. As corrupt as many of you claim the judiciary is, courts judgements base on evidences. You should wonder why Atiku had to sue CSU to release BAT's academic records. He is trying to prove his case beyond all reasonable doubts. #AllEyesOnTheJudiciary people should get this into your ignorant skulls: If you provide incontrovertible evidences in court, it would be extremely difficult for a "corrupt" judge to miscarry justice in your case.
