Winning FCT Not Requirement To Emerge President – Falana

Legal luminary, Femi Falana says a presidential candidate does not need to win the Federal Capital Territory (FCT) to be declared winner of the February 25, 2023 poll.

“It is not a requirement that you must win the FCT,” the Senior Advocate of Nigeria said on Channels Television’s Sunrise Daily programme on Tuesday.

“Today, the courts have ruled that pursuant to Section 299 of the constitution, that the FCT should be treated as a state. That is the law.

"You don’t have to win the FCT; if you meet the requirement; that is two-thirds of the majority of states in the country. You don’t have to win the FCT,” the rights activist stressed.

Section 299 of the constitution says that for the purpose of interpretation of the Constitution, the FCT is regarded as a State.

The implication is that:

The FCT is a State but given a name.

Since the FCT is given a name by the drafts men, it won't be right to say 37 states.

However, the name is 36 States and the FCT. It simply means 37 states.

Tinubu has met the requirements.

The court has affirmed that position and the constitution is clear.

But the 2/3 of 37 states is not a whole number.

You need 25% there though, that's the interpretation of the law. The Federal Capital Territory (FCT), is the capital territory of Nigeria, and it is in this territory that the capital city of Abuja is located. The FCT is not a state but is istered by elected officials who are supervised by the federal government.

I think Buhari set us all up, they will definitely form an interim government while there is a rerun.

Even though I'm a born again Christian, I will like to use this opportunity to thank my fellow Nigerian Christians for voting massively for the candidate with the Muslim/Muslim ticket. This election has proven that we Christians and our Muslim brothers are one. Peter Obi tried to divide us by running a religious campaign but we Christians stood our ground and rejected him. The judgement ruled in favor of Shehu tho.
I think Awolowo claimed the 2/3 of 19 states was 13 while the court insisted it was 12 and not 13.
Going by the judgement, the 2/3 of 37 states is 24 and not 25 but then I'm even confused the more as to why it's so.

Secondly, even if a runoff is declared, Obi isn't the runner up. That's my fear. Runoff would be between Atiku and Tinubu.

Popular opinion has it that one needs to win 25% in 2/3 of the 36 states abi? And the 2/3 of 36 states is 24.
If FCT is recognized as a state then 2/3 of 37 states is 24.6 which is not a whole number.
Then it's possibly safe to say 2/3 of 36 states and FCT is 25 states and not 24 states as commonly believed.
